4442AN ORDINANCE OF TITLE 18 OF THE ING TO ZONING. ORDINANCE NO. 4442 THE CITY OF ANAHEIM AMENDING ANAHEIM MUNICIPAL CODE RELAT- THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC82-220 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the bound- aries of the zones set forth in said Title 18 by adopting a sec- tional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: THAT PORTION OF THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 14, TOWNSHIP 4 SOUTH, RANGE 11 WEST IN THE CITY OF ANAHEIM, RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11 ET SEQ., TOGETHER WITH THAT PORTION OF PARCEL 4 OF A MAP RECORDED IN BOOK 34, PAGE 38 OF PARCEL MAPS IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT NORTH 890 38' 40" EAST 152.81 FEET FROM THE NORTHWESTERLY CORNER OF SAID PARCEL 4; THENCE NORTH 890 38' 40" EAST ALONG SAID NORTHERLY LINE OF PARCEL 4 AND THE EASTERLY PROLONGATION OF SAID NORTHERLY LINE 190 FEET; THENCE SOUTH 0° 15' 12" EAST PARALLEL WITH THE EASTERLY LINE OF SAID PARCEL 4, 205.65 FEET TO A POINT ON THE NORTHERLY LINE OF THE LAND CONVEYED TO THE ORANGE COUNTY FLOOD CONTROL DISTRICT BY DEED RECORDED MARCH 5, 1959 IN BOOK 4614, PAGE 499, OFFICIAL RECORDS; THENCE ALONG SAID NORTHERLY LINE SOUTH 890 38' 55" WEST, 228.05 FEET; THENCE NORTH 100 13' 24" EAST 209.20 FEET TO THE POINT OF BEGINNING, ALL AS SHOWN ON THE LOT LINE ADJUSTMENT RECORDED JUNE 9, 1982 AS INSTRUMENT NO. 82-196740. 82-83-13 TOGETHER WITH THAT CERTAIN STRIP OF LAND 15 FEET IN WIDTH ADJACENT TO THE NORTHERLY LINE OF THE ABOVE DESCRIBED PROPERTY, LYING WESTERLY OF THE NORTHERLY PROLONGATION OF THE EASTERLY LINE OF THE ABOVE DESCRIBED PROPERTY AND EASTERLY OF THE NORTHEASTERLY PROLONGATION OF THE WESTERLY LINE OF THE ABOVE DESCRIBED PROPERTY. NOTE: BY CERTAIN RECORDED DOCUMENTS, SAID 15 FOOT STRIP OF LAND SHALL BE DEDICATED FOR PUBLIC USE., be changed to "RM -1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: 1. That sidewalks shall be installed along Orange Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 3. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 7. That the owner(s) of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896), in an amount as determined by the City Council, for each new dwelling unit prior to the issuance of a building permit. 8. That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit. 9. That the most easterly building shall be fire sprinklered as required by the City of Anaheim Fire Department. 10. That prior to issuance of building permits, the applicant shall present evidence satisfactory to the Chief Building Inspector that the proposed project is in conformance with Council Policy No. 542, Sound Attenuation in Residential Projects. -2- 11. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 12. That Condition Nos. 1, 2, 4, 5, 9 and 11, above-mentioned, shall be complied with prior to final building and zoning inspections. 13. In the event that subject property is to be divided for the purpose of sale, lease, or financing, a parcel map, to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fif- teen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circula- ted in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
