4455FOLLOWS: ORDINANCE NO. 4455 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING SECTION 18.02.031 AND AMENDING SECTIONS 18.02.030 AND 18.02.032 OF CHAPTER 18.02 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That new Section 18.02.031 be, and the same is hereby, added to Chapter 18.02 of Title 18 of the Anaheim Municipal Code to read as follows: "18.02.031 ZONE DISTRICTS - RECODIFICATION OF FORMER ZONING DISTRICT DESIGNATIONS. On July 18, 1972, the City Council of the City of Anaheim adopted Ordinance No. 3063 repealing those certain zoning regulations and the zone district designation entitled the "R-2-5000" Zone and adopting new zoning regulations and a new zone district designation in their place and stead. On December 10, 1974, the City Council of the City of Anaheim adopted Ordinance No. 3373 adopting a new comprehensive ordinance code which repealed those certain zoning regulations and zone district designations entitled the "R -A," "R -E," "R -H-22,000," "R -H-10,000," "R-0," 11R-1," "R-2," "R-3," "C-0, "CH," "C-1," "C-2," "C-3," "M-1," "M-2," "P-1," and "P -L" Zones and adopted certain new zone regulations and the zone district designations in their place and stead. On March 13, 1979, the City Council of the City of Anaheim adopted Ordinance No. 3982 amending the zoning regulations and the zone district designation entitled the "RM -4000" Zone and adopting a zone district designation in its place and stead. Any property heretofore incorporated into the "R -A" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -A-43,000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R -E" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -HS -43,000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R -H-22,000" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -HS -22,000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R -H-10,000" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -HS -10,000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R-0" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -10,000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R-1" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -7200" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R-2-5,000" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RS -5000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "RM -4000" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RM -3000" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "R-2" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RM -2400" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. -2- Any property heretofore incorporated into the "R-3" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "RM -1200" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "C -O" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "CO" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property incorporated into the "CH" Zone prior to January 9, 1975, and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "CL -HS" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "C-1" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "CL" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "C-2" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "CG" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "C-3" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "CH" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "M-1" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "ML" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. -3- Any property heretofore incorporated into the "M-2" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "MH" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "P-1" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "PD -C" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone. Any property heretofore incorporated into the "P -L" Zone and not subsequently reclassified to any other zone of the City shall be deemed incorporated into, and classified as property within, the "PLD -M" Zone of the City and shall be subject to the requirements of said zone to the same extent as if said property had been expressly reclassified into such successor zone." SECTION 2. That Section 18.02.030 of Chapter 18.02 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 18.02.030 ZONE DISTRICTS - GENERAL In order to classify, regulate, restrict and segregate the uses of land and buildings, to regulate and restrict the height and bulk of buildings and to regulate the area of yards and other open spaces about buildings, and to regulate the density of population, classes of zones are by this title established to be known as follows: .010 Residential Zones RS -A-43,000 RS -HS -43,000 RS -HS -22,000 RS -HS -10,000 Description Residential, Single -Family, Agriculture Zone - 43,000 sq. ft. lot area. Residential, Single -Family, Zone, Hillside Zone - 43,000 sq. ft. lot area. Residential, Single -Family, Hillside Zone - 22,000 sq. ft. lot area. That Section 18.02.032 of Chapter 18.02 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.02.032 ZONE DISTRICTS - DELINEATION OF BOUNDARIES Except as hereinafter provided, no building shall be erected, reconstructed or structurally altered, nor shall any building or land be used for any purpose other than is permitted in the same zone in which such building or land is located. The regulations hereby established and pertaining to each zone are as specified under each section defining each such zone. The location and boundaries of the various zones are shown and delineated on the Zoning Map of the City of Anaheim which Map is on file in the Planning Department of the City of Anaheim and which Map is incorporated herein by this reference, as the same may be amended from time to time by ordinance. Such Zoning Map may, for convenience, be divided into separate parts and each such part may, for purposes of identification, be subdivided into separate sections. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which viola- tions were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal pro- visions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as or- dinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and con- tinuations, and not as new enactments. SECTION 5. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elim- ination herefrom of any such portion as may be declared invalid. SECTION 6. CERTIFICATION The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -6- THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 18th day of October, 1983.
