3630ORDINANCE NO. AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 76R-347 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: All that certain land situated in the State of California, County of Orange, described as follows: PARCEL 1: The North half of the East quarter of the Northeast quarter of the Northwest quarter of Section 24, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom the Easterly 45.00 feet thereof. Also Excepting therefrom the Northerly 53.00 feet thereof. Also excepting therefrom that portion described as Parcel 110.1 in the deed to the County of Orange recorded September 8, 1972 in book 10315, page 641 of Official Records of said Orange County. -1- ATTY-28 75-76-35 PARCEL 2: The Easterly 45.00 feet and the Westerly 53.00 feet of the North half of the East quarter of the Northeast quarter of the Northwest quarter of Section 24, Township 4 South, Range 10 West, in the :Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous :Maps, records of Orange County, California. Excepting therefrom those portions thereof described as Parcel 111, 111.2 and Y3-112 in the deed to the County of Orange recorded January 11, 1973 in book 10510, page 104 of Official Records. now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE, and that it be changed to and incorporated in "RM -1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of struc- tural framing. 3. That subject property shall be served by underground utilities. 4. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 5. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 6. That a six (6) foot masonry wall shall be constructed along the south side of Omega Avenue as shown on Area Development Plan No. 94, Alternate 2; that reasonable landscaping with minimum fifteen (15) gallon size trees planted a minimum of twenty (20) feet on center and including irrigation facilities, shall be installed in the parkway the full distance of said wall, plans for said landscaping; to be submitted to and approved by the Superintendent of Parkway Maintenance; and that the owner(s) of subject property shall enter into an agreement with the City to perpetually maintain the above-mentioned landscaped parkway, the agreement to be a covenant to run with the land, as stipulated to by the petitioner. 7. That, in accordance with City Council Policy No. 542, sound attenuation measures shall be provided adjacent to Ball Road. 8. That Conditions Nos. 1, 2, 3, 4, 5, 6 and 7, above mentioned, shall be complied with prior to final build- ing and zoning inspections. -2- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning; map to be added to the City Zoning reap showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
