3619ORDINANCE NO. 3619 r AN ORDINANCE OF THE CITY OF ANAHPIP1 AMEND- ING TITLE 18 OF THE ANAHEIM MU14ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 76R-250 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Tract Map 9300 as shown in book 388 pages 14 - 17 of Miscellaneous 1 -laps on file in the office of the recorder of Orange County, Calif. now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and that it be changed to and incorporated in "RS -5,000" RESIDENTIAL, SINGLE- FAMILY ZONE subject to the following conditions: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 2. That, in order to minimize the visual impact and pre- serve the privacy of the existing homes to the south of subject property, a minimal number of two-story homes will be located ad- jacent to those existing one-story homes, as stipulated to by the petitioner. -1- ATTY-28 75-76-30 3. That development of subject property will conform to Council Policy No. 542, pertaining to sound attenuation adjacent to railroads, and that plans to reduce the noise level generated by the railroad shall be submitted to the City Council for review and approval prior to introduction of an ordinance rezoning sub- ject property, as stipulated to by the petitioner. 4. Prior to the introl,:.uction of an ordinance rezoning subject property, Condition No. 2, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. SECTION 2. The City Zoning slap shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Pap, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
