3595ORDINANCE NO. 3595 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 4, CHAPTER 4.31, SECTIONS 4.31.210 AND 4.31.220 OF THE ANAHEIM MUNICIPAL CODE RELAT- ING TO FIGURE MODEL STUDIO ESTABLISHMENTS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 4, Chapter 4.31, Sections 4.31.210 and 4.31.220 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "SECTION 4.31.210 SUSPENSION OF PERMIT The City Council may suspend any permit issued hereunder when it is determined that the holder of such permit has violated or permitted to be violated any of the general regulations set forth in this ordinance or violated or permitted on the premises the infraction of any law of the State of California; provided, however, that no per- mit shall be suspended under the terms of this Section unless hearing and notice thereof be given, which hear- ing shall be held before the Council not less than five (5) days from the date of service of notice upon the permittee and that at the hearing, the permittee shall be permitted to introduce such evidence as is material to the hearing. It is unlawful for any person to carry on the business of a figure model studio establishment until a permit suspended pursuant to this Section has been reinstated by the City Council." "SECTION 4.31.220 REVOCATION OF PERMIT Any permit issued hereunder may be revoked by the City Council upon a determination that the holder of such permit has violated any of the provisions set forth in this ordinance or violated or permitted on the premises the infraction of any law of the State of California; provided, however, that no permit shall be revoked un- der the terms of this Section unless a hearing shall have been held before the City Council to determine just cause for such revocation. Notice of such hear- ing shall be given in writing and served at least five (5) days prior to the date of hearing thereon. The notice shall state the ground of the complaint against the holder of such permit, or against the business carried on by the permittee at the figure model studio establishment, and shall state the time and place where such hearing will be held. This notice shall be served upon the permit holder by delivering the same to such person or by leaving such notice at the place of business or residence of the per- mit holder in the custody of a person of suitable age -1- and discretion. In the event the permit holder cannot be found and the service of such notice cannot be made in the manner herein provided, a copy of such notice shall be mailed, postage fully prepaid, addressed to the permit holder at his place of business or residence at least five (5) days prior to the date of such hearing. SECTION 2. The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
