3567ORDINANCE NO. 3567 AN OPDINANCE OF THE CITY OF ANAHEIM AMEND- ING ORDINANCE NO. 3190 APPROVING AND ADOPT- ING THE FIRST AMENDPENT TO THE REDEVELOPMENT PLAN FOR REDEVELOPMENT PROJECT ALPHA. WHEREAS, the Community Redevelopment Commission of the City of Anaheim (hereinafter referred to as the "Redevelopment Commission"), pursuant to the California Communitv Redevelopment Law, formulated and prepared the proposed First Amendment to the Redevelopment Plan for Redevelopment Project Alpha and transmit- ted said Amendment to the Anaheim Redevelopment Agency (herein- after referred to as the "Agency") ; and WHEREAS, the Agency submitted to the City Council of the City, of Anaheim (hereinafter referred to as the "City Council") said proposed First Amendment to the Redevelopment Plan, accom- panied ccompanied by the Report to City Council on the First Amendment; and WHEREAS, the Redevelopment Commission has recommended certain changes in the proposed First Amendment to the Redevelop- ment Plan, which changes are set forth in a resolution duly adop- ted by the Redevelopment Commission and submitted to the City Council; and WHEREAS, the Planning Commission of the City of Anaheim, by resolution, submitted its report and recommendation finding the said proposed First n . _.::}_..mut to the Redevelopment Plan to be in conformity with the General Plan and recormiending approval of said proposed Amendment, as changed; and WHEREAS, the Agency certified to the preparation and completion of the Initial Study of Environmental Impact and the Negative Declaration for said proposed First Amendment to the Re- development Plan in compliance with the California Environmental Quality Act of 1970, and the Administrative Regulations pertaining thereto, and the applicable Objectives, Criteria and Procedures of the Anaheim Redevelopment Agency; and WHEREAS, after due notice, a joint public hearing was held by the City Council, the Agency, and the Redevelopment Conunis- sion to consider said proposed First Amendment to the Redevelopment Plan; and WHEREAS, all actions required by law have been taken by all appropriate public agencies. NOW, THEREFORE, THE CITY COU'iTCIL OF THE CITY OF ANAHEIM DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The purposes and intent of the City Council with res- pect to the Project area, as hereby amended, are to eliminate all conditions of blight existing in the Project area, and insure, as far as possible, that all causes of blighted conditions will be either eliminated or protected against, and to provide for the participation of owners in the Project area to insure and encour- age the redevelopment of the Project area and then to assist and -1- foster the economical revitalization of the area; to relocate and assist the owners and occuaants as needed within the area; to de- velop and rebuild the public facilities in this area; to provide a safer and more efficient service for the people who will occupy the area or make use of its services and the public as a whole. SECTION 2. The City Council hereby determines that the First Amend- ment to the Redevelopment Plan for Redevelopment Project Alpha, including certain changes heretofore approved by resolution of the City Council, is necessary and desirable. SECTION 3. The First Amendment to the Redevelopment Plan for Re- development Project Alpha, as changed, is hereby approved and adopted and, as approved and adopted, is incorporated herein by reference and made a part hereof as if fully set out at length herein. SECTION 4. The Redevelopment Plan for Redevelopment Project Alpha, as hereby amended, is hereby designated the official redevelopment plan for Redevelopment Project Alpha. SECTION 5. The City Council hereby certifies that this Council has reviewed and considered the information contained in the Initial Study of Environmental Impact and the Negative Declaration for the First Amendment to the Redevelopment Plan for Redevelopment Pro- ject Alpha, together with any comments as may have been presented therewith, and hereby determines that said First Amendment to the Redevelopment Plan will not have a significant effect, or substan- tial adverse impact, on the environment. SECTION 6. The City Council finds and determines that: (1) The Project area, as hereby amended, was and still is a blighted area, the redevelopment of which was and is necessary to effectuate the public purposes declared in the Community Rede- velopment Law of the State of California. (2) The Redevelopment Plan, as hereby amended., will redevelop the Project area in conformity with the Community Redevelopment Lax,= of the State of California and in the interests of the public peace, health, safety and welfare. (3) The adoption and carrying out of the Redevelopment Plan, as hereby amended, is economically sound and feasible. (4) The Redevelopment Plan, as hereby amended, conforms to the General Plan of the City of Anaheim. (5) The carrying out of the Redevelopment Plan, as hereby amended, will promote the public peace, health, safety and wel- fare of the City of Anaheim and Will effectuate the purposes and policies of the Community Redevelopment Law of the State of Cali- fornia. -2- (6) The condemnation of real property, as provided for in the Redevelopment Plan, as hereby amended, is necessary to the operation of the Redevelopment Plan, as hereby amended, and ade- quate provisions have been made for payment for property to he acquired as provided by law. (7) The Agency has a feasible method and plan for the re- location of families and persons to be temporarily or permanently displaced from housing facilities in the Project area, as herehv amended. (8) There are or are being provided in the Project area, as hereby amended, or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project area, as hereby amended, decent, safe, and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reason- ably accessible to their places of employment. (9) The Redevelopment Plan, as hereby amended, will afford a maximum opportunity consistent with the sound needs of the locality as a whole for the redevelopment of the area by private enterprises. (10) In order to implement and facilitate the effectuation of the Redevelopment Plan, as hereby amended, it is found and deter- mined that certain official action must be taken by the City Council with reference, among other things, to changes in zoning, the vaca- ting and removal of streets, alleys, and other public ways, the establishment of new street patterns, the location and relocation of sewer and water mains and other Public facilities, and other public action and, accordingly, the City Council hereby: (a) Pledges its cooperation in helping to carry out the Redevelopment Plan, as hereby amended; and (b) Reauests the various officials, departments, boards and agencies of the City of Anaheirr hav- ing administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the P..edevel- opment Plan, as hereby amended; and (c) Stands ready to take appropriate action upon proposals and measures designed to effectuate the Redevelopment Plan, as hereby amended. SECTION 7. The Citv Council is satisfied that permanent housing_ facilities will he available within three vears from the time occupants of the Project area, as hereby amended, are displaced and that, pending the development of such facilities, there will be available to such displaced occupants adequate temporary hous- ing facilities at rents comparable to those in the City of Anaheir. at the tire of their displacement. SECTION 8. All written and oral objections to the First Amendment to the Redevelopment Plan for Redevelonment Project Alpha, as changed, are hereby overruled. -3- SECTION 9. The City Clerk is hereby directed to cause the incorpora- tion of the First Amendment to the Redevelopment Plan, as changed, hereby approved and adopted into the Redevelopment Plan for Rede- velopment Project Alpha. The City Clerk is further directed to send a certified copy of this Ordinance to the Agency, and the Agency is hereby vested with the responsibility for carrying out the Redevelopment Plan, as hereby amended, subject to the provi- sions of said Redevelopment Plan. SECTION 10. The Citv Clerk is hereby directed to record with the County Recorder of Orange County a description of the land within the Project area, as hereby amended, and a statement that proceed- ings for the redevelopment of the Project area, as hereby amended, will continue under the California Community Redevelopment Law. The Agency is hereby directed to effectuate recordation in compli- ance with the provisions of Section 27295 of the Government Code to the extent applicable. SECTION 11. The City Clerk is hereby directed, as promptly as prac- ticable following the adoption of this Ordinance, but in any event on or before January 1, 1977, to transmit a copy of this Ordinance, a copy of Ordinance No. 3190 approving and adopting the Redevelop- ment Plan, a copy of the description and statement recorded by the City pursuant to Section 10 of this Ordinance, and a map or plat indicating the boundaries of the Project area, as hereby amended, to the Tax Assessor of Orange County, to the Auditor -Controller of Orange County, to the governing body of each of the taxing agencies which levies taxes upon any property in the Project area, and to the State Board of Equalization. SECTION 12. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circula- ted in the City of Anaheim. This Ordinance shall take effect and be in full force immediately upon the final passage thereof.
