3530ORDINANCE NO. 353 AN ORDINANCE OF THE CITY OF ANAKF_.Iti AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 76R-118 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Those portions of the Northeast quarter of the Northwest quarter of Section 13, Township 4 South, Range 11 West, in the City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in book 51, page 11, Mis- cellaneous Maps, records of said Orange County, described as follows: PARCEL 1: The West 272.62 feet of the East 1,000.53 feet of the North 226 feet of the Northeast quarter of the Northwest quarter of said Section 13. EXCEPTING THEREFROM the North 66 feet. ALSO EXCEPTING THEREFROM that portion lying within the West 60 feet of the East 894.22 feet of said Northeast quarter of the Northwest quarter. -1- ATTY-28 75-76-18 PARCEL 2: An easement for road and utility purposes over the West 60 feet of the East 894.22 feet of the North 226 feet of the Northeast quarter of the Northwest quarter of said Section 13. EXCEPTING THEREFROM the North 66 feet. now is "CL" COMMERCIAL, LIMITED ZONE and that it be changed to and incorporated in the "RM -1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 2. That subject property shall be served by underground utilities. 3. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 4. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 5. That, in accordance with Council Policy No. 542, the property owner shall provide a sound barrier adjacent to Lincoln Avenue, said barrier to be capable of reducing the sound of motor vehicles to a maximum of 65 dB CNEL at any point 6 feet above ground level in all exterior areas other than driveways, carports, and parking areas. The residential structures shall be designed to limit the interior noise caused by motor vehicles to a maximum of 45 dB CNEL, on an annual basis, in any habitable room with win- dows closed. 6. That the developer improve the existing 60 -foot private roadway easement to include a 56 -foot road bed, standard curbs and gutters, and a 4 -foot parkway with a minimum 4 -foot sidewalk on subject property at his expense. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -2 THE FOREGOING ORDINANCE is approved and signed by me this 4th day of May , 1976. City Clerk AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF ANAHEIM The Board of Administration, Public Employees' Retirement System, herein- after referred to as Board and the CITY COUNCIL of the CITY OF ANAHEIM, here- inafter referred to as Public Agency having entered into a contract under the date of July 25, 1950, effective September 11 1950, as amended effective July 1, 1956, September 19 1956, July 1, 1959, May 1, 1962, August 1, 1962, January 22, 1965, April 28, 1967, September 27, 1968, July 2, 1971, October 11 1973, December 26, 1974, May 30, 1975, and June 25, 1975, -and as provided by Chapters 170 and 316, Statutes of 1971, which provide for participation of Public Agency in said System, Board and Public Agency hereby agree as follows: A. The following subparagraph shall be added to Paragraph 6 of said contract: 6. (f) Section 20024.2 (defining "final compensation" on the basis of average compensation earnable during the year immediately pre- ceding retirement or any other one year period elected by the member) for miscellaneous and/or safety members. B. Paragraphs 7 (a) and 7 (b) shall be stricken from said contract and the following Paragraph 7 (a) and 7 (b) shall be substituted therefor: 7. Public Agency shall contribute to said Retirement System as follows: a. With respect to miscellaneous members, the public agency shall contribute the following percentages of monthly salaries earned as miscellaneous members of said System: (1) 0.15 percent until June 30, 2000 on account of the liability for prior service benefits. (2) 9.53 percent on account of the liability for current service benefits. (3) 0.20 percent on account of the liability for the 1959 Survivors program. Ret. Form 702-1 „4 I, b. With respect to local safety members, the public agency shall contribute the following percentages of monthly salaries earned as local safety members of said System: t (1) 0.116 percent until June 30, 2001 on account of the liability for prior service benefits. (2) 21.120 percent on account of the liability for current service benefits. C.
