3523ORDINANCE NO. 3523 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MU14ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 76R-25 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF A14AHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: All that certain land situated in the State of Cali- fornia, County of Orange, City of Anaheim described as follows: That portion of Lots 3 and 4 in Block 23 of Golden State Tract, as shown on a map thereof recorded in book 4, pages 66 and 67 of Miscellaneous Maps, rec- ords of said Orange County, described as follows: Commencing at the intersection of the Southwesterly line of said Lot 3 with a line that is parallel with and distant Westerly 217.50 feet measured at right angles from the Easterly line of said Lot 3; thence North 70 26' 30" West along said parallel line a distance of 361.90 feet, said point being the true point of beginning; thence South 82° 33' 30" West 230.12 feet; thence South 290 19' 30" West 132.18 feet to a line that is parallel with and distant Northeasterly 20.00 feet measured at right angles from the Southwesterly line of said Lot 3; thence North 600 40' 30" West along said parallel line a distance of 376.31 feet; thence North 70 26' 30" West 325.51 feet to the Southerly line of land described as Parcel 2 in a Deed to the State of California filed February 25, 1954 as Document No. 28719, in the office of the Registrar of Titles in -1- ATTY-28 75-76-15 the office of the County Recorder of Orange County, California; thence North 820 33' 30" East 610.69 feet along said Southerly line and its Easterly pro- longation to a line that is parallel with and distant Westerly 217.50 feet measured at right angles from the Easterly line of said Lot 3; thence South 70 26' 30 East 444.86 feet to the true point of beginning. Excepting therefrom the Westerly 145.00 feet thereof measured along Northerly line of said lots. Also excepting therefrom that portion of said land lying North and Easterly of the following described line: Commencing at a point on the West line of the East 217.50 feet of said Lot 3 distant along said West line, South 70 19' 35" East, 368.16 feet from the North line of Canal Street 25.00 feet wide as shown on said map; thence Westerly along a non -tangent curve concave Northerly having a radius of 4948.00 feet from a tangent which bears South 860 07' 11" West, an arc distance of 336.32 feet to the Northerly line of the land described in deed to Freeway Indus- trial Center, Inc., recorded October 31, 1963 in book 6786, page 11 of Official Records. now is "RS -A-43,000(0)" RESIDENTIAL/AGRICULTURAL ZO_�dE and that it be changed to and incorporated in the "Mrl-1200(0)" RESIDENTIAL, MULTIPLE -FAMILY ZONE subject to the following conditions: la That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Pub- lic Works. 2. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent properties. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 7. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. 8. That the owners(s) of subject property shall pay to the City of Anaheim a proportionate share of the expense previously incurred by the City of Anaheim for the acquisition of right-of- way and street improvements in connection with the improvements to Jackson Avenue, said proportionate share being 24.350 of the total -2- costs and amounting to $3,331.08 for right-of-way acquisition and $3,947.97 for the street improvements, or a total of $7,279.05 as ---^ the proportionate share, as stipulated to by the petitioner, prior to the issuance of a building permit. 9. That the owner(s) of subject property shall pay drain- age reimbursement fees of $444.35 per acre to the City of Anaheim prior to approval of a grading plan or, in the event no grading plan is required, prior to issuance of a building permit. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. this 13th ATTEST: THE FOREGOING ORDINANCE is -approved and signed by me day of April - r -- - CITY CLERK OF THE 91TY OF ANAHEIM FAL JR: fm -3- STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
