3514ORDINANCE NO. 3514 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 67R-310 determining that a change or change— in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the southwest quarter of the southwest quarter of Section 23, T. 4 S., R. 10 W., in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, as shown on map recorded in Book 51, page 7, et seq., of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at the northwest corner of that certain land described as Parcel 1 in deed to the State of California recorded in Book 2303, page 74 of Official Records, in said office, said northwest corner being the intersection of the westerly line of said Section 23, with a line parallel with and distant Northerly 50.00 feet, measured at right angles, from the southerly line of said Section 23; thence along said westerly line, N. 00 151 35" W., 36.15 feet; thence N. 890 441 25" E., 34.00 feet to the true point of beginning; thence continuing N. 890 441 2511 E., 6.00 feet; thence S. 510 371 1111 E., 39.08 feet to a curve concave Northerly and having a radius of 395.00 feet; thence along said curve Easterly, from a tangent which bears -1- ATTY-28 66-67-61(67) N. 790 08' 18" E., through an angle of 141 471 13t1, an arc distance of 101.94 feet; thence N. 010 241 22" E., 18.50 feet; thence N. 540 261 4411 E., 204.53 feet to a tangent curve concave Southeasterly and having a radius of 600.00 feet; thence along said last mentioned curve, North- easterly, through an angle of 190 391 2811, an arc distance of 205.86 feet; thence tangent to said last mentioned curve, N. 740 06' 1211 E., 142.57 feet to the northeasterly line of that certain land conveyed to Clarence M. McNees by deed filed July 9, 1952 as Instrument No. 25829 in the office of the Registrar of Titles of said Orange County, distant along said north- easterly line, N. 40° 50' 15" W., 11.85 feet from the most easterly corner thereof; thence along said northeasterly line N. 400 50' 15 W., 42.39 feet to the beginning of a tangent curve concave Southwesterly having a radius of 970.00 feet; thence Northwesterly along said curve and its Northwesterly continuation through a central angle of 220 391 45", an arc distance of 383.67 feet, said continuation being also the South- westerly line of the land described in Parcel 2 of the deed to the State of California, recorded March 18, 1952, in Book 2303, page 74; thence tangent to said curve N. 630 301 00" W., 144.78 feet along said Southwesterly line and its North- westerly prolongation, said prolongation being also the Northwesterly line of said land conveyed to Clarence M. McNees hereinabove mentioned, to the beginning of a tangent curve concave North- easterly, having a radius of 780.00 feet; thence Northwesterly, through a central angle of 40 141 15t1, an arc distance of 57.69 feet; thence S. 77° 561 3611 W.., 29.00 feet; thence S. 341 241 391f W-% 122.84 feet to the beginning of a tangent curve concave Easterly, having a radius of 120.00 feet; thence Southerly along said curve through a central angle of 340 401 1411, an arc distance of 72.61 feet to the point of tangency thereof with the Easterly line of Haster Street, said Easter- ly line being parallel with a distant Easterly 30.00 feet, measured at right angles from the Westerly line of said Southwest quarter; thence Southerly along said parallel line to a line parallel with and distant Northerly 230.00 feet, measured at right angles from the Southerly line of said Southwest quarter; thence Easterly along said last mentioned parallel line, 4.00 feet to a line parallel with and distant Easterly, 34.00 feet, measured at right angles from said Westerly line; thence Southerly along said last mentioned parallel line to the True Point of Beginning. now is "RS -A-43,00011 that it be changed to RECREATION ZONE upon RESIDENTIAL/AGRICULTURAL ZONE and and incorporated in "C-R" COMMERCIAL the following conditions: -2- 1. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer, and in accordance with standard plans and specifications on file in the Office of the City Engineer, at the time the property is developed. 2. That the owner(s) of the subject property shall install street lighting as required by the Utilities Director except when the Utilities Director shall permit the payment of street lighting fees -in the amount of $2.00 per front foot. 3. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot for tree planting purposes, said amount to be paid at the time the property is developed. 4. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Street, prior to final building inspections. 5. That all air conditioning facilities shall be properly shielded from view and shall be in architectural conformance with the structure. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby apprcved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
