3389FOLLOWS: ORDINANCE NO. ��89 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REPEALING CERTAIN SUB- SECTIONS OF TITLE 18 AND ADDING NEW SUB- SECTIONS IN THEIR PLACE RELATING TO GAR- AGE SETBACKS IPJ ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That the following subsections of the Anaheim Municipal Code be, and the same are hereby, repealed: 18.21.063.010, 18.22.o63.010, 18.23.063.013, 18.24.063.011, 18.25.o63.011, 18.26.063.011, 18.27.063.012. SECTION 2. That Title 18 of the Anaheim 'Municipal Code be, and the same is hereby, amended by adding thereto the following subsections to read as follows: 18.21.063.010 MINIMUM DEPTH OF REQUIRED FRONT YARD: Not less than twenty-five (25) feet as measured from the planned highway right-of-way line provided, how- ever, that any "front -on" garage equipped with an operable automatic vehicle access door opener may be permitted to encroach to a depth of not less than six (6) feet from the front property line subject to all the following conditions: .011 That no such garage shall be set back between the distances of ten (10) to twenty-five (25) feet from the front property line. .012. That the minimum average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average, no additional averaging credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .013 That not less than three (3) residential parking; spaces shall be provided in any front -on garage located less than twenty-five (25) feet from the front property line. .014 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. -1- .015 That, in keeping with the intent of this provision to provide for varied setbacks, the setback: to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. 18.22.063.010 REQUIRED SETBACKS AND YARDS: There shall be a setback area at least fifteen (15) feet in depth adjacent to any property line provided, however, that the minimum setback to any "front -on" garage shall be not less than twenty-five (25) feet un- less said garage is equipped with an operable automatic vehicle access door opener, in which case a minimum setback of not less than six (6) feet may be permitted, subject to all of the fol- lowing conditions: .011 That no such garage shall be set back between the distances of ten (10) to twenty-five (25) feet from the front property line. .012 That the minimum average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average, no additional averaging credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .013 That not less than three (3) residential parking spaces shall be provided in any front -on garage located less than twenty-five (25) feet from the front property line. .014 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. .015 That, in keeping with the intent of this provision to provide for varied setbacks, the setback to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. 18.23.063.013 "FRONT -01111 GARAGES: The minimum setback to any "front -on" garage shall be not less than twenty- five (25) feet unless said garage is equipped with an operable automatic vehicle access door opener, in which case a minimum setback of not less than six (6) feet may be permitted, subject to all of the following conditions: .0131 That no such garage shall be set back between the distances of ten (10) to twenty-five (25) feet from the front property line. -2- .0132 That the minimum average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average, no additional averaging credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .0133 That not less than three (3) residential parking spaces shall be provided in any front -on garage located less than twenty-five (25) feet from the front property line. .0134 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. .0135 What, in keeping with the intent of this provision to provide for varied setbacks, the setback to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. 18.24.063.011 y7INIMUM GARAGE SETBACK: The minimum setback. to any garage excepting "front -on" garages shall be not less than ten (10) feet. The minimum setback to any "front on" garage shall be not less than twenty- five (25) feet unless said garage is equipped with an operable automatic vehicle access door opener, in which case a minimum setback of not less than six (6) feet may be permitted, subject to all of the following conditions: .0111 That no such garage shall be set back between the distances of ten (10) to twenty-five (25) feet from the front property line. .0112 That the minimum_ average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average, no additional averagin-g credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .0113 That not less than three (3) residential parking spaces shall be provided in any front -on garae located less than twenty-five (25) feet from the front property line. .0114 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. .0115 That, in keeping with the intent of this provision to provide for varied setbacks, the setback to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. -3- 18.25.063.011 "FRONT -ON" GARAGES: The minimum setback to any �-- "front -on" garage shall be not less than twenty- five (25) feet unless said garage is equipped with an operable automatic vehicle access door opener, in which case a minimum setback of not less than six (6) feet may be permitted, subject to all of the following; conditions: .0111 That no such garage shall be set back between the distances of ten (10) to twenty-five (25) feet from the front property line. .0112 That the minimum average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average, no additional averaging credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .0113 That not less than three (3) residential parking spaces shall be provided in any front -on -ara ge located less than twenty-five (25) feet from the front property line. .0114 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. .0115 That, in keeping with the intent of this provision to provide for varied setbacks, the setback to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. 18.26.063.011 "FRONT -013" GARAGES: The minimum setback to any "front -on" garage shall be not less than twenty- five (25) feet unless said garage is equipped with an operable automatic vehicle access door opener, in which case a minimum setback of not less than six (6) feet may be permitted, subject to all of the following conditions: .0111 That no such garage shall be set back between the distances of ten (10) to twenty-five (2.5) feet from the front property line. .0112 That the minimum average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average, no additional averaging credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .0113 That not less than three (3) residential parking; spaces shall be provided in any front -on garage located less than twenty-five (25) feet from the front property line. -4- .0114 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. .0115 That, in keeping with the intent of this provision to provide for varied setbacks, the setback to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. 18.27.063.012 11FRONT-0411 GARAGES: The minimum setback to any "front -on" garage shall be not less than twenty- five (25) feet unless said garage is equipped with an operable automatic vehicle access door opener, in which case a minimum setback of not less than six (6) feet may be permitted, subject to all of the following conditions: .0121 That no such garage shall be set back between the distances of ten (10) to twenty-five (25) feet from the front property line. .0122 That the minimum average setback to all front -on garages located on the same block shall be not less than twenty (20) feet and provided that in computing said average no additional averaging credit shall be given for any garage setback any distance greater than thirty (30) feet from the front property line. .0123 That not less than three (3) residential parking spaces shall be provided in any front -on garage located less than twenty-five (25) feet from the front property line. .0124 That the setback to any front -on garage located on the curved portion of any cul-de-sac street shall be not less than twenty-five (25) feet. .0125 That, in keeping with the intent of this provision to provide for varied setbacks, the setback to any adjacent front -on garages permitted at less than twenty-five (25) feet shall be varied by not less than three (3) feet. SECTION 3. SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. -5- Sri,C TTON 4_ The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Lulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
