RESOLUTION NO. 3646
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ACCEPTING A GRANT FROM SOUTHERN PACIFIC
COMPANY OF THE RIGHT TO CONSTRUCT, RECONSTRUCT,
!1AINTAIN AND OPERATE A lO-INCH WATER PIPE LINE
BENEATH THE TRACKS AND UPON AND ACROSS THE PRO-
PERTY OF SOUTHERN PACIFIC COMPANY BETWEEN WEST
ANAHEIM AND STANTON, AND CROSSING THE CENTER
LH,rE OF SAID COHPANY IS l1A!N TRACK 'AT E. S. 76+89;
AND AUTHORIZING THE EXECUTION OF AN INDENTURE
COVERING THE CONSTRUCTION, MAINTENANCE AND OPERA-
TION OF SAID PIPE LINE.
WHEREAS, The Southern Pacific Company, a corporation of
the State of Delaware, has tendered to'the City of Anaheim an
indenture granting to the City of Anaheim, subject to the terms,
covenants and conditions therein contained, the right to con-
struct, reconsotruct, maintain and operate a 10-inch water pipe
line beneath the tracks and upon and across the property of
Southern Pacific Company between '..vest Anaheim and Stanton, in
the County of Orange, State of California, and crossing the
center line of said Southern Pacific Company's main track at
E.S. 76+89 in the location shown by a red line on the print of
Southern Pacific Companyls Yuma Division Drawing A-2010, Sheet
No.1, Revised November 6, 1956, attached to and made a part of
the i~denture above mentioned; and
WHEREAS, said grantor has tendered to the City of Ana-
heim the indenture above mentioned, dated December 3, 1956, to
be executed by said Southern Pacific Company and the City of
Anaheim, which indenture the City Council finds would be for the
benefit and best interest of the City of Anaheim and should be
approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
Ci ty of Anaheim that the indenture tendered to the City of Ana-
heim by the Southern Pacific Company, a corporation of the State
of Delaware, granting to the City, but subject to the terms,
covenants and conditions therein contained, the right to construct,
reconstruct, maintain and operate a lO-inch water pipe line be-
neath the tracks and upon and across the property of the Southern
Pacific Company between West Anaheim and Stanton, in the County
of Orange, State of California, and crossing the center line of
said Companyls main track at E.S. 76+89 in the location shown by
a red line on the print of Southern Pacific Company1s Yuma Divi-
sion Drawing A-2010, Sheet No.1, Revised November 6, 1956,
attached to and made a part of said indenture, which indenture is
dated December 3, 1956, be, and the same is hereby approved and
accepted;
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said inden-
ture for and on behalf of the City of Anaheim.

BE IT FURTHER RESOLVED that the City Treasurer of the City
of Anaheim be, and she is hereby, authorized to pay to the Southern
Pacific Company, for and in consideration of the granting of said
right or easement, the sum of $25.00.
THE FOREGOING RESOLUTION is approved and signed by me this
8th day of January, 1957.
