57R-3642 - - r"". - RESOLUTION NO. 3'42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DEtERMINING THAT A CHANGE OF ZONE IS NEOESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTIOLE IX, CHAPTER 2, OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the tone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct two public hearings to consider such proposed change of zone or zones and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its oninions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the Oity Planning Commission, the City Council did thereupon fix the )rd day of DeCamb~r ,1956, as the time and the Council Chambers in the ity Hall of ~City of Anaheim as the place for a public hearing upon sald proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the Oity Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop- erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: --~ That certain lot, piece or parcel of land situate, lyiag aad beiag in Rancho San Juan Cajon de Santa Ana, County of Orange, State of California, bounded and particularly descrlbed as follows, to wit: The West qne-half (Wi) of the Northwest Quarter (NWi) of the Northwest Quarter (NWi) of the Northwest Quarter (XWi) of Section 16, Township 4 So~th, Range 10 West, S.B.B. & M., estimated to contain five (5) acres, RESERVING therefrom -1- 7~ ~"t -;;;-:/ :i 7 "-- for roads, railroads, and ditches a strip of land thirty (30) feet wide, along, adjoining and each side of the Township, Range and Section 1 ines. ,...., The above conveyed propert~ being further de- scribed as the West half (t) of Lot Four (4) of Helen and Lynchts Addition to Anaheim, as shown on a map recorded in Book 442, page 158 of Deeds, records of Los Angeles County, California, and more particularly described as follows: Beginning at the Northwest corner of said section 16 and running thence ~ast along the North line of said Section 16, 330.08 feet to a point; thence southerly 663.55 feet to a point oa the South line of said Hprthwest Quarter (NWt) of the Northwest Quarter (NWt) of the Morthwest Quarter (NWt), which said point is 330.50 feet East of the West line of said Section 16; thence Westerly along said South line of the Horthwest Quarter (NWi) of the Northwest Quarter (NWt) of the Northwest Quarter (NWt) 330.50 feet to the Southwest corner of said Horthwest Quarter (NWt) of the Northwest Quarter (NWi) of the Northwest Quarter (NWt); thence Northerly along the West line of said Section 16, ~65.05 feet to the point of beginning and containing 5.037 acres of land, and excepting the northerly and westerly thirty (30) feet for road purposes. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE, to the following lones, subject to the conditions hereiaafter set forth: That that portion of subject property situated at the Southeast corner of Lincoln and Euclid Avenues, 140 feet by 140 feet, be changed to C-3, HEAVY COMMERCIAL Z~, and that the remaind.. of subject property be ch.nged to C-l, NEIGHBORHOOD COMMER C!AL ZONE, subject to the following conditions: 1. That the owner of subject property deed to the City of Anaheim a strip of land 20 feet in depth along Euclid Avenue for street widening purposes. 2. That suitable drainage be provided on the south side of the property for the properties to the east, as required by the City Engineer. 3. That the owner of subject property place of record appropriate C-) and C-l Deed Restric- tions as required by ~he City of Anaheim and approved by the City Eagineer. ~ r---. -2- ,- r BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
