63-0402RESOLUTION NO. 63R -402 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -103 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 14th day of May 19 63 as the time and the City Council Cham in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 62 -63 -103 The east half of those portions of Lots 7 and 8 in Block 17 of a Subdivision of the South half of Sec- tion 21, Township 4 South, Range 10 West, of the San Bernardino Meridian, being a part of the Fairview Colony Tract, in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 1, page 33 of Miscellaneous Record Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point on the South line of said Lot 7, South 89 51' 10" East 460.40 feet from the southwest corner of said lot, said point being southeast corner of the land conveyed to Robert H. Hudson and Carrie B. Hudson, husband and wife, by deed recorded October 27, 1950, in Book 2094, page 16 of Official Records; thence North 0 33' 10" East 668.87 feet along the East line of said land to the North line of said Lot 7; thence South 89 43' 50" East 202.00 feet along the North line of said lots; thence South 0 33' 10" West 668.17 feet to the South line ofsaid Lot 8; thence North 89 51' 10 "West 202.00 feet to the point of beginning. EXCEPT the North 300.00 feet thereof. ALSO EXCEPT the West 101.00 feet thereof; be excluded from R -0, ONE FAMILY SUBURBAN ZONE, and incorporated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 60 feet in width, from the center line of the street, along Katella Avenue for street widening pur- poses. 2. (a) That all engineering requirements of the City of Anaheim along Katella Avenue, including pre- paration of improvement plans and installation of all improvements, such as curbs and gutters, side- walks, street grading and paving, drainage faci- lities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineer- ing requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Katella Avenue, for street lighting purposes. 4. That trash storage areas shall be provided in accord- ance with standard plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 5. That a 6 -foot masonry wall shall be constructed along the north property line, prior to final building inspection. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 14th day of May, 1963. ATTEST: 6. That the owners of subject property shall place of record City of ,Anaheim C- 1,Deed Restrictions, approved by the City Attorney, which restrictions shall limit the C -1 uses of subject property to business and professional offices, only. 7. That subject property shall, be developed substan- tially in accordance with plans on file with. the City of Anaheim,, received. by the Planning Depart- ment on May 10, 1963, and marked "Exhibit No. 1, Revision No. 1," and "Exhibit No. 2." 8. That at such time as commercial development is proposed for the northerly portion of subject property, plans for such development shall be submitted to the City Council for approval prior to the issuance of a building permit. 9. That Conditions Nos. 1, 3 and 6 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
