63-0375RESOLUTION NO. 63R -375 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 367. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from RUSSELL MOORE, 11752 Garden Grove Boulevard, Garden Grove, California, permitting a waiver of the one -story height limitation restriction, and the construction of a two story, planned -unit, multiple- family residential development on the following des- cribed property situated in the City of Anaheim, County of Orange, State of California, to wit: The South 140 feet of the East one -half of the Northeast quarter of the Southeast quarter of Section 14, in Town- ship 4 South, Range 11 West, in the Rancho Los Coyotes, city of Anaheim, as shown on a map thereof recorded in book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the Easterly 40 feet of said land, as conveyed to the State of California, by deed recorded March 5, 1951, in book 2153, page 254, Official Records, and by deed recorded March 1, 1951, in book 2151, page 460, Official Records. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on April 1, 1963, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 696, Series 1962 -63, denying Conditional Use Permit No. 367; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 7th day of May, 1963, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that Conditional Use Permit No. 367 should be denied. -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 367 be, and the same is hereby sustained, and that the request of RUSSELL MOORE, 11752 Garden Grove Boulevard, Garden Grove, California, for a Conditional Use Permit granting a waiver of the one -story height limitation restriction and permitting the construction of a two story, planned -unit, multiple- family residential development on the property hereinabove described, be and the same is hereby denied.
