63-0283RESOLUTION NO, 63R 283 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZCNES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 to consider an amendment to Title o t e 'na eim 'un c'pal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 9th day of April 1963 as the time and the City Council Chambers in the City Hall of tie City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones. in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard,,and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of Lot 4 and Lot 5 of Anaheim Extension, as shown on a Map of Survey by William Hamel, a copy of which is shown in Book 3, pages 162 to 164 inclusive of "Los Angeles County Maps," in the office of the County Recorder of Orange County, California, described as follows: -1- 62 -63 -83 Beginning at a point on the center line of Center Street, as shown on said map, distant North 74 37' 25" East 950.13 feet from the inter- section of said center line with the center line of East Street, as shown on said map; thence North 74 37' 25" East along said center line of Center Street 168.27 feet to the Southerly prolongation of a line parallel with and distant Easterly 24.29 feet, (measured along the Southerly line) from the Westerly line of Lot 5 of said,. Anaheim Extension; thence North 15 27' 55P West, along said parallel line, 480.00 feet to the Easterly prolongation of the Southerly line of the land described in a deed to Zion Evangelical Lutheran Church of Anaheim recorded June 30, 1961 in Book 5770, page 813 of Official Records; thence South 74 37' 25 West along said prolongation and along said Southerly line, 168.78 feet to a line parallel with said center line of East Street and passes through the point of beginning; thence South 15 24' 15" East along said parallel line 480.00 feet to the point of beginning. be excluded from C -1, NEIGHBORHOOD COMMERCIAL and R -A, RESIDENTIAL- AGRICULTURAL ZONES and incorporated in R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Lincoln Avenue, for street widening purposes. 2. That sidewalks and driveways shall be installed on Lincoln Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 4. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 5. That fire hydrants shall be installed as required and determined necessary by the Chief of the Fire Department, prior to final building inspection. 6. That the owner of subject property shall deed to the City of Anaheim a three -foot public utility and a two -foot overhang easement along the northerly boundary of subject property, and shall deed to the City of Anaheim a three -foot overhang easement along the easterly boundary of subject property. -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 9th day of April, 1963. ATTEST: 7. That subject property shall be developed sub- stantially in accordance with Exhibits Nos. 1, 2 and 3, as amended herein, on file with the City of Anaheim. 8. That a six -foot masonry wall shall be constructed along the northerly boundary of subject property prior to final building inspection. 9. That tree wells shall be installed at 40 -foot intervals along the parkway portion of Lincoln Avenue abutting subject property, prior to final building inspection. 10. That Conditions Nos. 1, 2 and 6, above mentioned, shall be complied with within a period of 180 days from date hereof or such further time as the City Council may grant. DENE M.
