63-0219RESOLUTION NO, 63R 219 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No, 62 -63 to consider an amendment to Title lb of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 26th day of March 1963 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: The North half of the Southwest quarter of the South- west quarter of the Northwest quarter of Section 23, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, as shown on a map thereof recorded in Book 51, page 11, Miscellaneous Maps, records of said Orange County; EXCEPT the South 2 acres thereof. alm 62 -63 -76 be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the follow- ing conditions: 1. (a) That all engineering requirements of the City of Anaheim along Knott Avenue, including preparation of improvement plans and installation of all im- provements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Knott Avenue, for street lighting purposes. 3. That the owners of subject roperty shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 4. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. 6. That the access drives shall be of a minimum width of 21 feet, with adequate angle cut -offs provided, or of a minimum width of 28 feet if no cut -offs are provided; and that said access drives shall, in all cases, have a minimum vertical clearance of 14 feet. 7. That a 6 -foot masonry wall shall be constructed along the north, east and south boundaries of subject pro- perty, prior to final building inspection. 8. That the interior walls of the proposed carports shall be stuccoed; that enclosed storage cabinets shall be provided along the rear wall of each car- port; that adequate bumper guards shall be provided to protect the interior walls of the proposed car- ports; and that all of said items shall be completed and complied with prior to final building inspection. 9. That subject property shall be developed substan- tially in accordance with Exhibit No. 1, Revision No. 1, and Exhibit No. 2 filed in connection with these reclassification proceedings, and on file with the City of Anaheim. 2 11. That Conditions Nos. 1(b) and 2 above mentioned shall be compliedwith within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council a1 ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
