63-0206.1:SOLUT ION NO. 63R-206 A .,LESOLUTION OF THE CITY CCUAC1L OF THE CITY OF ANAHEIM APPROVING AND AUTHOIZING THE EXECUTION OF AN ,/,GEEMENT BETWEEN THE CITY OF ANAHEIM AND THE ROMAN CATHOLIC ARCHBISHOP OF LOS ANGELES WITH REFE :ENCE TO THE ABANDUNMENT AND CONTINUED USE OF A PORTION OF A CERTAIN SETv.E'2_ LINE. WHEREAS, The Roman Catholic Archbishop of Los .,An.,,eles, a Corporation Sole, aas requested the abandonment of an easement for public utility purposes upon, along, over and through the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The Northerly 10.00 feet of the Southerly 177.25 feet of the Westerly 326.25 feet of the Easterly 511.50 feet of Vineyard Lot D-6 as shown on a map filed in Book 4, pages 629 and 630 of Deeds, accords of Los Angeles County, California. AND WHEREAS, the City of Anaheim has declared its in- tention to vacate and abandon said easement for public utility purposes; and WHEREAS, the City Council finds that it is in the best interests of the City and said Archbishop that the sewer line lying within said easement be permitted to remain in place subject to the continued use and control thereof by said Archbishop; and WHEREAS, the City, in order to permit said sewer line to remain in place rather than to remove the same, must require said Roman Catholic Archbishop of Los Angeles, a Corporation Sole, to save the City harmless from any liability which might arise because of the existence of said sewer line in said easement after the same has been abandoned; and WHEREAS, a form of "Save Harmless Agreement" to be made and entered into by and between the City and said Roman Catholic Archbishop of Los Angeles has this day been submitted to the City Council for approval; and WHEREAS, the City Council does find that said agreement would be in the best interest of the City; that the terms thereof are satisfactory; and that said agreement should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement this day submitted to the City Council to be made and entered into by and between the City of Anaheim and The Roman Catholic Archbishop of Los Angeles, a Corporation Sole, with reference to the abandonment of a certain easement and the continued use of a portion of the sewer line within said easement by said Archbishop, as more particularly hereinabove mentioned and described, be and the same is hereby approved. 1 BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby, authorized to execute said agreement for and on behalf of the City of Anaheim.
