63-0650WHEREAS, under date of May 1, 1963, pursuant to
sealed bids thereon the City of Anaheim entered into an
agreement with E G ENGINEERS, INC. for the removal of
noxious weeds; and
WHEREAS, through inadvertance and mistake said
agreement of May 1, 1963, failed to reflect the specifica-
tions upon which said bids were made in that said agreement
provides for withholding all payment to the contractor
until thirty -five (35) days after the filing of notice of
completion when said specifications required the withholding
of only ten per cent (10%); and
WHEREAS, said work of weed abatement has been
completed to the satisfaction of the City and the City
desires to amend said agreement of May 1,1963, to reflect
said specifications by providing for immediate payment to
said E G ENGINEERS, INC. ninety percent (90 of said
contract price.
NOW, THEREFORE BE IT RESOLVED by the City Council
of the City of Anaheim that it amend and it does hereby
amend that certain agreement dated May 1, 1963, between
the City of Anaheim and E G ENGINEERS, INC. relating to
weed abatement by providing therein that said E G Engineers,
Inc. be paid a sum equal to ninety per cent (90 of the
contract price of said contract upon completion thereof.
AND BE IT FURTHER RESOLVED that the Finance
Director be and he is hereby authorized and directed to
forthwith pay to E G ENGINEERS, INC. a sum equal to
ninety per cent (90 of the contract price of said agree-
ment of May 1, 1963.
THE FOREGOING RESOLUTION is approved and signed
by me this 30th day of July, 1963.
