63-0638RESOLUTION NO. 63R- 638 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT DEED CONVEYING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR EASEMENTS FOR PUBLIC UTILITY AND INGRESS AND EGRESS PURPOSES. WHEREAS, the City Council of the City of Anaheim is desirous of purchasing the hereinafter described real property for municipal purposes, to wit: Easements for public utility and ingress and egress purposes; and WHEREAS, the owner of said property has offered to sell and convey the same to the City; and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interest of the City of Anaheim to accept said offer and purchase said real property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of ROBERT C. MILLER, a married man, as his sole and separate property, to sell to the City of Anaheim the following described real property situated in the City of Anaheim, County of Orange, State of California, to be used for easements for public utility and ingress and egress purposes, and more particularly described as follows: PARCEL ONE: An easement for road and public utility purposes over, under and across those portions of Lots 9 and 10 of the Miles Rancho, as shown on a Map recorded in Book 4, page 7 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of Lot 16 of Tract No. 2820, as per Map recorded in Book 95, pages 1 and 2 of Miscellaneous Maps, records of said Orange County; thence South 00 28' 59' East 60.00 feet to the Northwest corner of Lot 15 of said Tract No. 2820; thence South 89 31' 01" West 3.03 feet to a tangent curve concave Northerly whose radius is 230.00 feet; thence Westerly and Northwesterly 64.75 feet along the arc of said curve through a central angle of 16 07' 45 thence tangent to said curve North 74 21' 14" West 63.53 feet to a curve concave Southerly whose radius is 170.00 feet; thence Northwesterly and Westerly 47.47 feet along the arc of said curve through a central angle of 16 00' 00 thence tangent to said curve South 89 38' 46" West 316.37 feet to a curve concave Southeasterly whose radius is 15.00 feet; thence Southwesterly 23.62 feet along the arc of said curve through a central angle of 90 13' 00 thence tangent to said curve and parallel to the center line of West Street South 00 34' 14" East 343.94 feet; thence South 89 38' 46" West 32.00 feet to the center line of West Street; thence along said center line of West Street, North 00 34' 14" West 420.00 feet; thence North 89 38' 46" East 32.00 feet; thence South 00 34' 14" East 1.00 feet; thence North 89 38' 46" East 331.66 feet to a curve concave Southerly whose radius is 230.00 feet; thence Easterly and Southeasterly -1- 64.23 feet along the arc of said curve through a central angle of 16 00 00 thence tangent to said curve South 74 21' 14" East 63.53 feet to a curve concave Northerly whose radius is 170.00 feet; thence Southeasterly and Easterly 47.86 feet along the arc of said curve through a central angle of 16 07' 45 thence tangent to said curve North 89 31' 01" East 3.03 feet to the point of beginning. PARCEL TWO: An easement for electric power line overhang purposes over, under and across the Easterly five feet and the Southerly five feet of that portion of Lot 9 and Lot 10 of said Miles Rancho, described as follows: Beginning at the Southwest corner of Lot 16 of Tract No. 2820, as shown on a Map recorded in Book 95, pages 1 and 2 of Miscellaneous Maps, records of Orange County, California; thence South 00 28 59" East 60.00 feet to the Northwest corner of Lot 15 of said Tract No. 2820; thence South 89 31' 01" West 3.03 feet to a tangent curve concave Northerly and having a radius of 230.00 feet; thence Westerly and Northwesterly along the arc of said curve through a central angle of 16 07' 45" an arc distance of 64.75 feet; thence tangent to said curve North 74 21' 14" West 63.53 feet to a curve concave Southerly and having a radius of 170.00 feet; thence Northwesterly and Westerly along said curve through a central angle of 16 00' 00" an arc distance of 47.47 feet; thence tangent to said curve South 89 38' 46" West 316.37 feet to the beginning of a curve concave Southeasterly and having a radius of 15.00 feet; thence Westerly and Southwesterly along said curve through a central angle of 90 13' 00" an arc distance of 23.62 feet to an intersection with a line parallel with and 32.00 feet Easterly of the center line of West Street; thence tangent to said curve South 00 34' 14" East 343.94 feet; thence North 89 38' 46" East 505.68 feet; thence North 0 28' 59" West 386.00 feet; thence North 89 31' 01" East 3.03 feet to the Northwest corner of Lot 15 of said Tract No. 2820; thence North 00 28' 59" West 60.00 feet to the point of beginning. PARCEL THREE: An easement for ingress and egress purposes over and across the Southerly 20 feet of the Easterly 30 feet and the Southerly 20 feet of the Westerly 10 feet of the Easterly 85 feet and the Southerly 20 feet of the Westerly 25 feet and the Southerly 20 feet of the Easterly 10 feet of the Westerly 180 feet of the entire land described above as Parcel Two. The easements described above in Parcel Three may be used for public utility purposes also. be, and the same is hereby, accepted by the City Council of the City of Anaheim, and that the City of Anaheim accept a convey- ance of said property. BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owner or owners of said real property, out of General Funds of the City of Anaheim, the sum of One Dollar ($1.00).
