57R-4264 - .-, r- RESOLUTION NO. 4264 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETmRMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTIC~E IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CQDE SHOULD. BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE; AND RESCIND- ING RESOLUTION NO. 2593. WHEREAS, the City PlannlngCommission of the City Of Anaheim has heretofore duly passed and adopted a resolution declar- ing its iatention to change the boun~ies of the zone or zones hereinafter mentioned and described ~d did fix a time and place for the holding of a pUblio hearing thereon in the manner and as prescribed in Article IX, Chapter 2 oif the Anaheim Munioipal COde, and did duly hold and oonduct such publio hearing to oonsider said proposed change of zone or zones, and did reoeive evidence and repcrts from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning OOmmission did duly announce by formal resolution its findings of facts and deolare its opinions and reasons for recommending an amendment to said Article IX, Ohapter 2 of the Anaheim Municipal Code to effeot the proposed ohanges in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and reoommendation of the City Planning Commission, the City Counoil did thereupon fix the 14th day of Deoember, 1954, as the time and the Council Chamber in the City Hall of the City of Anaheim as the plaoe for a publio bearing upon said proposed ohange of zone, and did give notice thereof in the manner ..d as provided in said Artiole IX, Chapter 2 of the Anaheim Municipal COde; and WHEREAS, at the time and plaoe fixed for said public hear- ing, the City Counoil did dUly hold and oonduct suoh publiC hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the reoommendations of the City Planning Commission; and did adopt Resolution No. 2593 deolaring its intention to ohange the boundaries of the zone or zones therein desoribed, upon the oondi- tions set forth therein; and WHEREAS, additional information has now been furnished the City Oouncil relative to said proposed ohange of zone, and the City Counoil does find that an ordinanoe direoting said ohange of zone and completing said proceeding has never been adopted; NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the City of Anaheim that all of the property and area situated in the Oity of Anaheim, Co~nty of Orange, State of California, desoribed as follows, to wit: ,~ Beginning at a pOint on the south line of Lot 5, Anaheim Extension, as per map made by Wm. Hamel on file in the Recorder's Otfioe of Los Angeles County, whioh point is 24.268 feet easterly from the southwest corner of Lot 5, running thence -1- 1 ,;2 .5;1--..5'"$- ~ I~ ~ ~ . -- .-., J''-'' easte~ly along the cente~ line of East Cente~ St. 5.05 chains to the Cemet.~y Road; thence no~therly along the west sid. of said ~oad to the south line of the Cemete~y; thenoe westerly along the south line of said Cemete~y and con- tinuing said line in the same di~ection to a point easte~ly from the west line of Lot 5, 24.888 feet; thence southerly parallel with the west line of Lot 5 to the pOint of beginning. That the~e be no entrances on Cemetery Road. 2. That openings be allowed on Cente~ St~eet. 3. That that po~tion of Lot 4 used fo~ parklng purposes shall be fenced along Cemete~y Road with a J-foot o~namental fence to enclose the parklng area. 4. That the owne~s of subject prope~ty place of ~eoo~d standard Cl ty of Anahelm 0-1 and ~3 Deed Rest~lctions covering the ~espeotive areas, and that the 0-1 restrlotions p~oh1bit the ule of the p~operty for a drive-ln. BE IT FURTHER RESOLVED that the City Atto~ney be, and he 11 hereby, authorlzed and directed to prepare and submit to the City Council an amendment to Article IX, Chapte~ 2 of the Anaheim Munlcipal Code to amend sald Anaheim Municipal Code to accomplish the object he~ein found and dete~mined to be necessary and p~oper. AND BE IT FURTHER RESOLVED that RESOLUTION NO. 2593 be, and the same is hereby ~escinded.
