63-0553RESOLUTION NO. 63R -553 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -117 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 25th day of June 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 62 -63 -117 PARCEL 1: The West 200.00 feet of that portion of the Southwest quarter of Section 4, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of said Section 4; thence East along the South line of said Section, 1,320 feet; thence North and parallel with the West line of said Section, 282 feet; thence Westerly to a point on the West line of said Section, 240 feet Ncr th of the point of beginning; thence South 240 feet to the point of beginning. EXCEPTING THEREFROM the South 200 feet. PARCEL 2: The West 200.00 feet of that portion of the Southwest quarter of Section 4, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the point on the West line of said Section 4, 240 feet North from the Southwest corner of said Sec- tion 4; thence North along said West line to the Westerly extension of the South line of Lots 2 and 3, as shown on a Map filed in Book 1, page 55 of Record of Surveys in the Office of the County Recorder of Orange County, California; thence Easterly along said extended line and the South line of said Lot 2 and the Easterly extension thereof to an intersection with the Northerly extension of the East line of the land described in Parcel 1 in the deed to Alice M. Beckett Krick and husband, recorded December 22, 1945, in Book 1374, page 217 of Official Records; thence Southerly along said extended line to the Northeast corner of the land described in said Parcel 1; thence Westerly along the Northerly line of said Parcel 1 to the point of beginning. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Street for street widening purposes. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Euclid Street, for street lighting purposes. 3. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No. 1." -2- 4. That the air conditioning facilities shall be contained within the building or shielded from view. 5. That tree wells shall be provided at approxima- tely 40 foot intervals in the Euclid Street park- way abutting subject property; that plans for said tree wells and the landscaping therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted prior to final building inspec- tion. 6. That a 2 -foot strip of land shall be landscaped and said landscaping maintained as indicated on Exhibit No. 1 on file with the City of Anaheim; that plans for said landscaping shall be sub- mitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 7. That the existing irrigation ditch along the north property line shall be replaced with underground irrigation facilities, prior to final building in- spection, and said underground irrigation facilities shall be subject to approval of the City Engineer. 8. That a 6 -foot masonry wall shall be constructed along the east property line, extending from the existing masonry wall to the north property line, which wall shall be constructed prior to final building inspection. 9. That the completion of these reclassification pro- ceedings is contingent upon the granting of Variance No. 1575. 10. That Conditions Nos. 1 and 2 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Muni- cipal Code to accomplish the objects herein found and determined to be necessary and proper.
