A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AND AUTHORIZING THE
EXECUTION OF AN INDENTURE GRANTING TO THE
CITY THE RIGHT TO CONSTRUCT AND USE A STREET
OR HIGHWAY UPON AND ACROSS CERTAIN REAL PROP-
ERTY OF THE PACIFIC ELECTRIC RAILWAY COMPANY.
WHEREAS, the City of Anaheim is desirous of obtaining
an easement upon and across the hereinafter described real prop-
erty for street or highway purposes; and
WHEREAS, the Pacific Electric Railway Company, owner
of said property, has offered to grant to the City the right to
construct, reconstruct, maintain and use a street or highway
upon or across said property, subject to the teems, covenants and
conditions set forth in a certain indenture this day submitted to
the City Council by said Pacific Electric Railway Company to be
made and entered into by and between the City and said Railway
Company, dated March 6, 1963; and
WHEREAS, the City Council finds that it would be for
the benefit and best interest of the City to accept said offer
and enter into said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the indenture this day submitted to the
City Council by the Pacific Electric Railway Company dated March 6,
1963, to be made and entered into by and between the City of
Anaheim and said Pacific Electric Railway Company, granting to
the City the right to construct, reconstruct, maintain and use a
street or highway upon and across the following described property
situated in the City of Anaheim, County of Orange, State of
California, to wit:
PARCEL 1.
The North 30 feet of the South 60 feet of the West half
of the Southwest quarter of the Southeast quarter of
Section 23, Township 4 South, Range 10 West, in the
Rancho San Juan Cajon de Santa Ana, in the City of
Anaheim, County of Orange, State of California, as said
section is shown on map recorded in Book 51, page 10
of Miscellaneous Maps, in the office of the County Re-
corder of said county.
EXCEPTING THEREFROM the West 45 feet thereof.
PARCEL 2.
That portion of the North 30 feet of the South 60 feet
of the Southeast quarter of the Southwest quarter of
Section 23, Township 4 South, Range 10 West, in the
Rancho San Juan Cajon de Santa Ana, in the City of
Anaheim, County of Orange, State of California, as said
section is shown on map recorded in Book 51, page 10 of
Miscellaneous Maps, in the office of the County Recorder
of said county, bounded on the east by the westerly line
of the East 45 feet of the Southeast quarter of the
Southwest quarter of said section, and bounded on the
subject to the terms, covenants and conditions set forth in said
indenture, be and the same is hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to sign said indenture for and
on behalf of the City of Anaheim.
