63-0503RESOLUTION NO. 63R-503 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 395 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from CALARK CORP., 10502 West Katella Avenue, Anaheim, California, for a Conditional Use Permit to construct five (5) single-family dwelling units on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: All that portion of the North 10 acres of the South 20 acres of the Northeast quarter of the Southwest quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as per Map recorded in Book 51, Page 11 of Mis- cellaneous Maps, in the office of the County Recorder of said Orange County, described as follows: Commencing at a point in the Easterly line of the Northeast quarter of the Southwest quarter of said Section 14, distant thereon South 0 16' 02 East 674.59 feet from the Northeast corner thereof, and running thence South 89 38' 34" West 45.00 feet to the point of beginning; thence continuing South 89 38' 04' West a distance of 310.00 feet more or less to the Northeast corner of Lot 71 of Tract 1646, as shown on a hap thereof recorded in Book 106, Pages 16, 17 and 18 of Miscellaneous Maps, in the office of the County Recorder of said Orange County; thence South along the Easterly line of said Lot 71, 70.31 feet to the Southeast corner thereof, said point being on the North line of Lot 73 in said Tract 1646; thence North 89 37' 57' East along the North line of said Lot 73, a distance of 20.36 feet to the Northeast corner there- of; thence South 0 22' 03 East along the East line of said Lot 73, a distance of 100.00 feet to the Southeast corner thereof, said point being on the North line of Stonybrook Drive, as shown on the Map of said Tract 1646; thence Easterly along said North line of Stonybrook Drive, a distance of 43.38 feet to the Southwest corner of that certain parcel of land as excepted in the deed to Yontatega Homes, Inc., a corporation, recorded July 28, 1958, in Book 4363, Page 367 of Official Records; thence North 0 22' 03' West along the West line of said excepted parcel, a distance of 80.70 feet to the Northwest corner thereof; thence North 89 38' 04 East along the North line of said excepted parcel, a distance of 240.48 feet to the Northeast corner thereof; thence North 0 16' 02" West a dis- tance of 90.00 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City April 15 of Anaheim upon said application on notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 714, Series 62-63 granting Conditional Use Permit No.395, upon the conditions therein set forth and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in rantin said Conditional Use Permit and said appeal was set or pu lc hearing on y 1963 at the City Hall, in the City of Anahe and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting said Conditional Use Permit be, and the same is hereby sustained and that Conditional Use Permit No. 395 be, and the same is hereby, granted permitting the construction of five (5) single- family dwelling units on the property hereinabove described, subject to the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Stonybrook Drive and Western Avenue, for street lighting purposes. -2- 1 That the owner of subject property shall .pay to the City of Anaheim the sum of `25.00 per dwelling unit, to be used for park and recreation purposes said amount to be paid at the time the building permit is issued. 3 That adequate areas for trash storage, accessible to trash truck pickup, shall be provided as determined and required by the Street Mainte- nance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection, 4. That driveways shall be constructed on Stonybrook Drive and Western Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. 6. That subject property shall be developed sub stantially in accordance with plans on file with the City of Anaheim, marked "Exhibit No. 1, Revision No. 2," and "Exhibits Nos. 2, 3, 4, 5, and 6, Revision No. 1. 7. That a six -foot masonry wall shall be constructed along the westerly boundary of subject property, where said property abuts -1 Zone property, which wall shall be constructed prior to final building inspection. 10. That Conditions Nos. 1, 4 and 9 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. THE FOREGOING RESOLUTION is approved and signed by me this llth day of June, 1963. ATTEST: 8. That the structural height of the four (4) easterly dwelling units shall be limited to one story. 9.
