57R-4226A .- _. RESOLUTION NO. 4226 A A RESOLUTION OF THE OITY OOUNCIL OF THE OITY OF ANAHEIM DENYING VARIANCE NO. 781. WHEREAS, the Oity Planning Commission of the Oity of Anaheim did receive a petition from the owner of oertain real property situated in the Oity of Anaheim, County of Orange, State of California, described as follows: The North half of the Southwest quarter of the Southwest quarter and the North 1 foot of the South half of the Southwest quarter of the South- west quarter of Section 22, Township 4 South, Range 10 West, S.B.B. & M. AND WHEREAS, the Oity Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on July 22, 1957, notices of which said public hearing were duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspeotion, investi- gation and studies made by itself and in its behalf, and after due consideration of all evidenoe and reports offered at said hearing, did adopt Resolution No. 6 -- Series 1957-58, reoommending to the Oity Oouncil of the City of Anaheim that Varianoe No. 781 be granted upon the oondition therein set forth; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution a written appeal was filed with the City Counoil of the City of Anaheim protesting the action of the City Planning Oommission granting said varianoe, and said appeal was set for pUblic hearing on the 20th day of August, 1957, at 7:00 o'olock P.M., in the City Hall in the City of Anaheim, and notice of such pUblic hearing was duly given as required by law and the prOVisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, at the time and plaoe fixed for said public hearing, the City Oouncil did duly hold and oonduot suoh public hearing and did give all persons interested therein an opportunity to be heard, and did oontinue said hearing for a period of ninety (90) days to allow the applioant to meet oertain oonditions; and WHEREAS, after due investigation and studies made by 1tself and in its behalf, and after due oons1deration of all evidence and reports, the City Oouncil does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subjeot property. 2. It appears that the subject property can be adequately developed and used under the present zone. -' -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Variance No. 761, requesting permission to erect a 2,000- room, l2-story hotel, shops, etc. on the property hereinabove described, be, and the same is hereby disapproved, and that Variance No. 781 be, and the same is hereby, denied.
