57R-4220 ~, RESOLUTION NO. 4220 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Ana- heia ha. heretofore duly pa..ed and adopted I resolution declaring its intention to change the boundarhs of the !one or zonn herein- art.r aentioned and de.cribed and did fix a time and place for the holding of a public hearing thereon in the manner and IS pre.cribed in Article IX, Chapter 2 of the Anaheim Municipal COde, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons int.rested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by for..l resolution its findings of facts and declare its opinions and r.a.on. for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the ~day of No~er, 19 '7 , as the time Ind the Council ~in the City Man of the City of Anaheim as the place for I pu~llc hearing upon said proposed change of zone, and did give notice thereot in the manner and as provided In said Article IX, Chapter 2 ot the Anaheim MUnicipal Code; and WHEREAS, at the time and place fixed for saId public hear- ing, the City Council did duly hold and conduct such public h.aring and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations ot the City Planning Commi..ion; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed trom the lone in which it Is now tltuated to a different zone, as hereinafter ..t forth, Is 1I0re .uitable for the zone or zon.. to which it is propo..d to Change .ald property and are. and thlt the Inclusion of said prop.rty and ar.a In such n.w zone or zone. will lncreas. the value of .aid property and area and will not depr.clate the value. of prop.rty In adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the Ctty Council of the City of Anaheim that all of the property and area situated In the City of Anaheim, County of Orange, Stlte of California, described al follow., to wit: PARCEL 1. - That portion of the Southwest quarter of the Southwest quarter of Seotion 18, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, desoribed as follows: Beginning at a pOint in the West line of said Seotion 18, distant thereon 1.59.00 feet North of the Southwest corner thereof, and running thence North along said -1- - West line, 129.00 feet; thence East parallel with the South line of said Section, 294.00 feet; thence South parallel with the West line of said Section, 129.00 feet; thence West, parallel with the South line of said Section, 294.00 feet to the point of beginning. PARCEL 2. That portion of the Southwest quarter of the Southwest quarter of Seotion 18, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, desoribed as follows: Beginning at a point in the West l1ne of said Section 18, distant 288.00 feet North of the Southwest oorner thereof, and running thence North along said West line, 144.00 feet; thenoe East, parallel with the South l1ne of said Seotion 18, 294.00 feet; thence South parallel with said West l1ne of Seotion 18, 144.00 feet; thence West parallel with the South line of said Section, 294.00 feet to the point of beginning. (Said property is located at 9942 and ~952 Magnolia Avenue, Anaheim, California.) be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to 0-1, NEIGHBOR- HOOD COMMEROIAL ZONE, upon the following conditions: 1. That the owners of subject property deed to the City of Anaheim a strip of land 20 feet in width along Magnolia Avenue for street widening purposes. 2. That a 6-foot concrete block wall be construoted along the north and east property lines where the sUbjeot property abuts residential property; said wall to be made a part of building and not a part of street work and to be construoted before final inspection of the building is made. 3. That the owners of subjeot property place of record standard City of Anaheim 0-1 Deed Restriotions, approved by the City Attorney. 4. That all engineering requirements of the City of Anahelll, suoh as ourbs and gutters, sidewalks, street grading and paving, drainage faoilities or other pertinent work be complied with as required by the City Engineer. 5. Said change of zone shall not become effective unless within sixty days, or such further time as the Counoil may grant, the restriotions herein required to be imposed upon the property shall have been executed by the owners of the property, submitted to the City for approval and filed of reoord, nor until deeds for street widening or utility purposes, when required, have been executed and delivered to the City. -2- - - BE IT FURTHER RESOLVED that the C1 ty Attorney be, and he is hereby, authorized and direoted to prepare and sublli t to the C1ty Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
