57R-4196 -- RESOLUTION NO. 419' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on Dote.er 21, 1957 , notices of which said publio hearings were duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Munioipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidenoe and reports offered at said hearing, did adopt its Resolution No. 92 ,recommending to the City Ooun- oil of the City of Anaheim that Varianoe No. ai2 be granted upon the conditions stated in said resolution; an WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the sarne vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. ,.~ 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to OARL MAXWELL, 11452 Barclay Drive, Gardea Grove, Oalitornla, to erect &ad operate a Xotel, with .vt.alag poel, store bu1141ags &ad oottee shop on tae propert;r hereiaa.ove desorlbed, sUDJect te the tollowlng condltlo.s: -1- ."'~ 1. The erection of the buildings in conformity with the plans presented to the City Council and on 'file with the City; except that the living rooms shall be enlarged to 12 feet by 14 feet. Z. That the owner of subject property deed to the City of Anaheim a strip of land 57 feet in width, from the center line of the street, along Brookhurst Street, for street widening purposes. ). That the building set-back on Brookhurst Street be a minimum of 50 feet from the property line. 4, That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other pertinent work be oomplied with as required by the City Engineer. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner &kK~~_~_ his heirs, successors or assigns, to comply with the AnaheimlMunicipal Code and regulations and the conditions herein.
