63-0796RESOLUTION NO. 63R -796 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 63 -64 -29 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 1st day of October 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 63 -64 -29 PARCEL 1: That portion of Lot 4 of South Placentia Tract No. 2, as per map thereof recorded in Book 5, at page 42, of Miscellaneous Maps, records of said Orange County, described as follows: Beginning at a point in the North line of the Parcel of land described in Parcel 1 of the deed to W. L. Morris and wife dated April 11, 1940, and recorded in Book 1039, at page 285, of Official Records, in the Office of the County Recorder of said Orange County, distant thereon 445 feet Easterly from the inter- section of said line, or the extension thereof, with the centerline of Cypress Avenue, and running thence Easterly, along said North line, 210 feet; thence Southerly, parallel with the West line of said Lot 4, to the Southeasterly line of said parcel of land conveyed to Morris; thence Southwesterly, along said Southeasterly line to a line extending Southerly, parallel with the West line of said Lot 4, from the point of beginning; thence Northerly along said parallel line to the point of beginning. PARCEL 2: The Northerly 120.00 feet (measured along the Westerly line) of that portion of Lot 4 of South Placentia Tract No. 2, as shown on a Map recorded in Book 5, page 42 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of said Lot 4; thence Northerly 598.25 feet along the West line of said lot; thence Easterly parallel with the North line of said Lot to a point which is distant 340.00 feet Easterly measured along said parallel line and the extension thereof, from the center line of Cypress Avenue; thence Southerly parallel with the West line of said Lot 4 to the Southeasterly line of said lot; thence South- westerly along said Southeasterly line to the South line of said lot; thence Westerly 85.90 feet along said South line to the point of beginning. EXCEPTING THEREFROM that portion lying Westerly of a line parallel with and Easterly 215.00 feet from said center line of Cypress Avenue. PARCEL 3: The Northerly 200.00 feet of that portion of Lot 4 of South Placentia Tract No. 2, as shown on a Map recorded in Book 5, page 42 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the North line of the parcel of land described in Parcel 1 of the deed to W. L. Morris and wife, recorded April 12, 1940 in Book 1039, page 285 of Official Records, distant thereon 340 feet Easterly from the intersection of said line, or the extension thereof, with the center line of Cypress Avenue; thence Easterly, along said North line, 105 feet; thence Southerly, parallel with the West line of said Lot 4, to the Southeasterly line of said parcel of land conveyed to Morris; thence Southwesterly along said Southeasterly line to a line extending Southerly, parallel with the West line of said Lot 4 from the point of beginning; thence Northerly along said parallel line to the point of beginning. be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE, and incor- porated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Placentia Avenue for street widening purposes, and shall also dedicate to the City the necessary land for the proposed cul -de -sac. 2. (a) That all engineering requirements of the City of Anaheim along Placentia Avenue and the proposed cul -de -sac, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject City of Anaheim the sum of along Placentia Avenue and for street lighting purpos property shall pay to the $$2.00 per front foot, the proposed cul -de -sac, es. 4. That the owners of subject property shall deed to the City of Anaheim a three -foot public utility overhang easement along the northerly boundary of subject property. 5. That the area indicated as "Not a Part" on Exhibit No. 1, Revision No. 1, on file with the City of Anaheim, shall be incorporated within the develop- ment by the filing of a petition for reclassification of said area to R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE. 6. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No. 1, Revision No. 1" and "Exhibit No. 2."
