63-0791RESOLUTION NO. 63R -791 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 63 -64 -10 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, re thereon the Planning within a did duly days adopt p tw an g said hearing tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 27th of August 1963 day as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 63 -64 -10 PORTION A: All of Tract No. 3011, as shown on a Map recorded in Book 94, pages 12 and 13 of Miscellaneous Maps, records of Orange County, California. EXCEPTING THEREFROM the Southerly 27.00 feet lying within Midway Drive and the Southwesterly 14.00 feet lying within Palm Street. PORTION B: Blocks 2, 3, 4 and 5 of Tract No. 419, as shown on a Map recorded in Book 16, page 2 of Miscellaneous Maps, records of Orange County, California; Lot 5 and the Southerly 12.40 feet of Lot 4 of Joseph Fiscus Subdivision, as shown on a Map re- corded in Book 8, page 73 of Miscellaneous Maps, records of said Orange County; and A triangular parcel of Lot 7 of Joseph Fiscus Sub- division, as shown on a Map recorded in Book 8, page 73 of Miscellaneous Maps, records of said Orange County, bounded on the North by the South line of Midway Drive, on the East by the Westerly line of Block 5 of said Tract No. 419, and on the Southwest by the Northeasterly line of the Santa Ana Freeway; EXCEPTING THEREFROM the Northerly 150 feet of the Easterly 90 feet measured from the existing center line of Midway Drive. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE and R -1, ONE FAMILY RESIDENTIAL ZONE, and incorporated in R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions which shall apply to Portion "B" only: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 28 feet in width, from the center line of the street, along Midway Drive, extending from the Santa Ana Freeway approximately 290 feet easterly, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Midway Drive, including preparation of improvement plans and installa- tion of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That a 6 -foot masonry wall shall be constructed along the westerly boundary of Portion "B" where said property abuts the Santa Ana Freeway right of way. -2- 6. That all of the above conditions shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes along Zeyn, Lemon, Clementine and Dickel Streets and Midway Drive, for those portions where said sum has not been paid under previous zoning applications. 5. That the owners of subject property shall pay the City of Anaheim the sum of 125.00 for the reclassification of those parcels of Por- tion "B" in accordance with the minutes of the meeting of the City Council held on February 26, 1963. approved and signed by me STATE OF CALIFORNIA COUNTY OF ORANGE ss.
