RES-2006-212RESOLUTION NO. _2fl_Q6-212 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING SUPERSEDING BOUNDARY MAP FOR CITY OF ANAHEIM COMMUNITY FACILITIES DISTRICT N0.06-2 (STADIUM LOFTS} WHEREAS, on July 11, 2006, the City Council (the "City Council") of the City of Anaheim (the "City") adopted a resolution entitled "A Resolution of the City Council of the City of Anaheim of Intention to Establish a Community Facilities District and to Authorize the Levy of Special Taxes" (the "Resolution of Intention"), stating its intention to form a community facilities district (the "Community Facilities District") proposed to be named the City of Anaheim Community Facilities District No. 06-2 (Stadium Lofts) pursuant to the Mello-Roos Community Facilities Act of 1982 (the "Act"); WHEREAS, the proposed boundaries of the Community Facilities District are shown on the map entitled "Proposed Boundaries of City of Anaheim Community Facilities District No. 06-2 (Stadium Lofts) County of Orange, State of California" (the "Original Boundary Map"), which map was, pursuant to the Resolution of Intention and the Act, filed with the City Clerk of the City and was, pursuant to the Resolution of Intention and the Act, recorded as instrument number 2006- 474343 in Book 91 at Pages 40-41 M/M of Maps of Assessments and Community Facilities Districts in the office of the Orange County Recorder; and WHEREAS, a map entitled "Superseding Boundaries of City of Anaheim Community Facilities District No. 06-2 (Stadium Lofts) County of Orange, State of California" (the "Superseding Boundary Map") reflecting a lot line adjustment in the proposed Community Facilities District and cross-referencing to the Original Boundary Map has been filed with the City Clerk of the City; NOW, THEREFORE, the City Council of the City of Anaheim does hereby resolve, determine and order as follows: Section 1. The foregoing recitals are true and correct. Section 2. The City Council hereby orders that the boundaries of the territory proposed for inclusion in the Community Facilities District be modified as reflected in the Superseding Boundary Map. The Superseding Boundary Map is hereby approved and reference to the Superseding Boundary Map is hereby made for further particulars regarding the territory proposed for inclusion in the Community Facilities District. Pursuant to Section 31 13.5 of the Streets and Highway Code of the State of California, the City Council hereby directs that the modification to the Original Boundary Map be consolidated in a single map, which map is designated as the Superseding Boundary Map. The City Clerk of the City is hereby directed to record, or cause to be recorded, said map of the superseded boundaries of the Community Facilities District in the office of the Orange County Recorder within ten days of the date of adoption of this Resolution.
