63-0084RESOLUTION NO. 63R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commiss on of the City of Anaheim did hold a public hearing in Reclassification Proceedings No, 62 to consider an amendment to Title lb of the Anaheim MuTTc1 Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence anc reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 2nd day of January 19 63 as the time and the City Ccundi1 hambers in the City Hall of t e City of Anaheim as the place for a public hearing upon said proposed amendment, to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: Lots 96, 97, 98, 100, 101 and 102 of Tract No. 1565 in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book No. 37, Page No. 20 of Miscellaneous Maps, records of said County. Also the following described parcels of land: T =1- 62 -63 -29 Those portions of Lot 11 of Anaheim Extension, as shown on a Map of Survey made by William Hamel in 1868 on file in the office of the County Recorder of Los Angeles County, California, described as follows: PARCEL NO. NINE: Beginning at the Northwest corner of that parcel of land conveyed to Willis E. Ford, a married man, by Deed No. 19386, recorded February 14, 1958 in Book 4196, page 524 of Official Records of Orange County, California; thence North 74 31' 15" East 162.08 feet along the Northerly line of said parcel of land to an intersection with the center line of State College Boulevard (formerly Placentia Avenue) as said State College Boulevard is shown on the Map of Tract No. 1565, recorded in Book 49, pages 20 through 24, inclusive, of Miscellaneous Maps, records of Orange County, California; thence North 0 10' 55" East 190 feet, more or less, along the center line of said State College Boulevard to an intersection with the Easterly prolongation of the Southerly line of Lot 102 of said Tract No.1565; thence South 74 31' 15" West 116.99 feet, more or less, along the said Easterly prolongation and Southerly line of said Lot 102 to the Southwest corner of said Lot 102; thence South 0 10' 55" West 131.83 feet along the Easterly lines of Lots 120, 119 and a portion of the East line of Lot 118, to an angle point in the East line of said Lot 118, all of said Tract No. 1565; thence South 15 23' 45" West 50.48 feet along a portion of the East line of said Lot 118 and a portion of the East line of Lot 117 of said Tract No 1565, to the point of beginning. PARCEL NO. TEN: Beginning at the intersection of the center line of Santa Ana Street, with the Southerly prolongation of the Easterly line of Lot 103 of Tract No. 1565, as shown on a Map thereof recorded in Book 49, pages 20 to 24, inclusive, of Miscellaneous Maps, records of Orange County, California; thence North 15 23' 45" West along said Southerly prolongation, and along the Easterly line of Lots 103 and 117 of said Tract No. 1565, a distance of 222.58 feet; thence North 74 31' 15" East parallel with the center line of said Santa Ana Street, 162.08 feet to a point in the center line of State College Boulevard (formerly Placentia Avenue),as shown on said Map of Tract No. 1565; thence South 0 10' 55" West along said center line 231.16 feet to the center line of said Santa Ana Street; thence South 74 31' 15" West along the center line of said Santa Ana Street a distance of 100.00 feet to the point of beginning, be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE and R -1, ONE FAMILY RESIDENTIAL ZONE, and incorporated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: -2- 1. That the owners of the property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along State College Boulevard for street widening purposes. 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection of any proposed alteration of existing residences and /or any new construction. 3. That the owners of the property shall pay to the City of Anaheim the sum of $2.00 per front foot along State College Boulevard, Broadway and Santa Ana Street, for street lighting purposes. 4. That the owners of Lots 96, 97, 98, 100, 101 and 102 shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of said property to business and professional offices only; shall provide that the front yards of said Lots 96, 97, 98, 100, 101 and 102 shall be fully landscaped and maintained as a condition of use, and shall not be blacktopped nor used for parking purposes; that the existing front yard setback on said lots shall not be substantially reduced; that all signs and advertising visible from State College Boulevard and Broadway shall be limited to one free standing, unlighted sign per lot, with a maximum area of 8 square feet, said signs to be of uniform appearance and subject to the approval of the Development Review Committee; and that no flags, banners, lighted signs, billboards or rotating devices shall be established in conjunction with the use of any existing residential structures. Said deed restrictions may be removed upon certifi- cation by the Chief Building Inspector that all existing residential structures have been removed from said lots. 5. That a 6 -foot masonry wall shall be constructed along the west side of Parcel No. Nine, prior to final building inspection of any construction on said parcel. 6. That the owners of the property shall deed to the City of Anaheim a strip of land 20 feet in width between Lot No. 102 and Parcel No. Nine, to be used for alley purposes, said 20 -foot strip to be improved to City standards as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 7. That outdoor storage of any materials shall be prohibited unless contained within an enclosed trash storage area. 8. Prior to the adoption of an ordinance or ordinances reclassifying any of the above described lots, the owner or owners of the respective lots shall submit to the City Council a plan of development incorporating the proposed structural and architec- tural revisions to the existing residential structures, together with proposed landscaping, garages and wall removal or rear yard clearance, and proposed parking lot layouts, which shall be limited to the rear yards of subject lots and shall be in accordance with Anaheim Municipal Code parking requirements. Upon completion of all applicable conditions, and upon approval by the City Council of the proposed use of development for each of the respective lots, the City Attorney shall prepare an ordinance reclassifying said lots individually. 9. Following removal of the required restrictions on Lots Nos. 96, 97, 98, 100, 101 and 102, and prior to final building inspection of any new construction thereon, provision shall be made for concrete paving and the installation of 5 X 5 -ft. tree wells, spaced at 40 -foot intervals in the parkway portion of the State College Boulevard and Broadway rights of way abutting subject lots, said landscaping to be subject to the approval of the Superintendent of Parkway Maintenance. A landscaped strip of a minimum width of 6 feet shall also be provided parallel to the State College Boulevard and Broadway rights of way abutting said lots, which strip shall be landscaped and said landscaping approved prior to final building inspection of any new construction on said lots. 10. Prior to the passage of an ordinance reclassifying Parcel No. Nine, a plan of development shall be approved by the City Council, said plan to incorporate the removal of all existing structures on said parcel, and to include tree wells spaced at 40 -foot intervals in the parkway portion of the State College Boulevard right of way abutting said parcel, and also to include a 6 -foot strip of landscaping abutting the State College Boulevard right of way, said tree wells and landscaping to be installed prior to final building inspection. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
