A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION 5453 TO PERMIT
A WAIVER OF THE MINIMUM BUILDING SETBACK LINE
FOR CERTAIN PROPERTY LOCATED AT OR NEAR THE
NORTHEAST CORNER OF HIGHWAY NO. 39 AND LINCOLN
AVENUE.
WHEREAS, the City Council of the City of Anaheim
duly approved Resolution No. 5453, dated August 25, 1959,
establishing a minimum building setback line of 35 feet from
the new property line on both sides of Lincoln Avenue; and
WHEREAS, the City Council finds that certain pro
perty located at or near the northeast corner of Highway No.
39 and Lincoln Avenue, in the City of Anaheim, County of
Orange, State of California, and more particularly described
as follows:
The west 205 feet of the south 190 feet of the
west half of the west half of the southwest
quarter of the southwest quarter of Section 12,
Township 4 South, Range 11 West, in the Rancho
Los Coyotes, County of Orange, State of Cali-
fornia, as said section is shown on a map re-
corded in Book 51, page 11 of Miscellaneous
Maps in the office of the County Recorder of
said County.
EXCEPT that portion thereof described in deed
to the State of California recorded May 28,
1941, in Book 1093, page 534, Official Records.
ALSO EXCEPT that portion thereof described in
deed to the State of California, recorded August
2, 1951, in Book 2212, page 122, Official
Records.
is presently being used for the purpose of operating an auto-
mobile service station; and
WHEREAS, the City Council does further find that the
owner of the aforementioned described property desires to con-
struct an open structure having a roof covering the existing
automobile gasoline pumps within the required 35 -foot minimum
building setback area and attach a certain existing advertis-
ing sign to the roof of said covering structure; and
WHEREAS, the City Council does further find that the
aforementioned covering structure with said existing advertis-
ing sign attached to the roof of said structure would not be
detrimental to the public health,safety and welfare nor other-
wise detrimental to the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 5453 be, and is
hereby, amended to permit the erection of the aforementioned
structure and advertising sign within the 35 -foot minimum

of property.
THE FOREGOING RESOLUTION is approved and signed
by me this 8th day of January 1963.
