63-0014RESOLUTION NO 63R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZCNES SHOULD BE CHANGED, WHEREAS, the City Planning Commis u n of the City of Anaheim did hold a public hearing in Reclassification Proceedings No 62 -63 to consider an amendment to Title 1i of the Anaheim MuETIFT al Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence anc reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings and recommendation of the City Planning Commission the City Council did fix the _and day of January 19 63 as the time and the City Ccundil Chambers in the City Hall of t ze City of Anaheim as the place for a Public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard,.and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, :situated in the City of Anaheim, County of Orange, State of California, to wit That portion of Lot 21 in the J. D. Taylor Tract, as shown on a map thereof recorded in book 36, pages 58 and 59, Miscellaneous Records of Los Angeles County, California, lying Southerly of the following described line: 62 -63 -44 Beginning at a point on the center line of Cross Street, (now known as Jefferson Street) as shown on said map, South 17 00' East 347.41 feet from its intersection with the Westerly prolongation of the Northerly line of said Lot 21; thence South 78 10' 10" East 237.29 feet; thence North 73 23' 00" East 246.68 feet to a point on the Northeasterly line of land described in deed to J. Shailer Arnold and wife, recorded August 8, 1945, in book 1326, page 224, Official Records, in the office of the County Recorder of said Orange County; thence South 36 23 00" East 310.46 feet, more or less, to an intersection with the semitangent line of curve course No. 20 of Riverside Road, Section 3, as laid out by the Orange County Highway Commission; EXCEPTING that portion lying South of the North line of the strip of land quitclaimed to the Santa Ana Valley Irrigation Company, by deed recorded July 18, 1934, in book 685, page 255, Official Records, in the office of the County Recorder of said Orange County. The Southerly boundary of said land and the Santa Ana Valley Irrigation Ditch is shown on a map of survey recorded in book 4, page 3, Record of Surveys, in the office of the County Recorder of said Orange County; ALSO EXCEPTING THEREFROM that portion thereof granted to the State of California, by deed recorded September 26, 1960, in book 5432, page 370, Official Records, in the office of the County Recorder of said Orange County, described as follows: Beginning at the intersection of the center line of Cross Street (now known as Jefferson Street), as shown on said map, with the center line of the Santa Ana Canyon Road, 60.00 feet wide, as described in deed to the County of Orange, recorded in book 171, page 144, Official Records, in the office of the County Recorder of said Orange County; thence along said last mentioned center line, South 71° 10' 33" East 336.46 feet; thence at right angles to said center line, North 18 49' 27" East 30.00 feet to the Northeasterly line of said Santa Ana Canyon Road and the true point of beginning of this description; thence tangent to said Northeasterly line, Easterly along a curve concave Northerly having a radius of 172.00 feet, through an angle of 63 31' 43" a distance of 190.71 feet; thence tangent to said curve North 45 17' 44" East 44.48 feet to the Northeasterly line of the parcel of land described in deed recorded in book 2308, page 203, Official Records, in the office of the County Recorder of said Orange County; thence Southeasterly along said Northeasterly line to the Northwesterly line of the strip of land described in deed to the Santa Ana Valley Irrigation Company, recorded in book 685, page 255, Official Records, in the office of the County Recorder of said Orange County; thence Southwesterly along said Northwesterly line to said Northeasterly line of said Santa Ana Canyon Road; thence Northwesterly along said last mentioned Northeasterly line to said point of beginning. be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE(R -3, MULTIPLE FAMILY RESIDENTIAL ZONE NOW PENDING), and incorporated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Santa Ana Canyon Road for street widening purposes. 2.(a)That all engineering requirements of the City of Anaheim along Santa Ana Canyon Road, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Santa Ana Canyon Road, for street lighting purposes. 4. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 5. That the completion of these reclassification proceedings is contingent upon the completion of Reclassification Proceedings No. 61 -62 -107 now pending, the approval of revised plans in connection with Reclassification No. 61 -62 -107, and upon the completion of the conditions of Conditional Use Permit No. 243 and approval of the revised plans in connection with said Conditional Use Permit No. 243. 6. That Conditions Nos. 1, 2(b) and 3 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby,authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
