78-141RESOLUTION Tu~O. 78R-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OP ANAHEIM DETERMINING THAT CERTAIN PUBLIC STREET(S) SHOULD BE ABANDONED AND ESTABLISTI- ING CONDITIONS PRECEDENT TO SAID ABANDONMENT (Hermosa Drive) WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1941 (Section 8300 et seq., Streets and Highways Code) in connection with requests for vacation and abandonment of public streets within the City of Anaheim; and WHEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the following described public street; to wit, Hermosa Drive (hereinafter "Street") more specifically described as follows: That portion of dedicated public street commonly known as Hermosa Drive lying within Tract No. 1681, as shown on a map recorded in Book 52, pages 18 and lq, Miscellaneous Maps, records of Orange County, located in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at the northeasterly corner of Lot 33 in said Tract No. 1681; thence N 66° 22' 38" E, 12.63 feet to the beginning of a tangent curve concave southwesterly and having a radius of 50 feet; thence Southeasterly along said curve through a central angle of 60° an arc distance of 52.36 feet to the beginning of a reverse curve concave northwesterly and having a radius of 50 feet, said point of beginning of said reverse curve being the true point of beginning; thence Southeasterly, Easterly, Northeasterly and Northwesterly along said reverse curve through a central angle of 130° an arc distance of 157.08 feet to an intersection with the centerline of said Hermosa Drive; thence Td 66° 22' 38" E, 6.70 feet along said centerline to an intersection with the southerly prolongation of the easterly line of Lot 18 in said Tract No. 1681; thence Td 23° 37' 22" W, 25.00 feet to an intersection with a line parallel with and 25.00 feet north- erly of the centerline of said Hermosa Drive; -1- 77-9A thence S 66° 22' 38" W, 124.23 feet along the last mentioned parallel line to a point in a line distant 49.77 feet from the west line of Lot 20 of said Tract No. 1691; thence S 230 37' 22" W, 50 feet to the true point of beginning. WHEREAS, on the 28th day of February, 1978, a public hearing was held to allow interested persons to submit evidence concerning said proposed abandonment; and WHEREAS, the City Council of the City of Anaheim does find from the evidence submitted to it that said Street is unnecessary for present or prospective public use; and WHEREAS, the City Council has further determined that certain conditions must be met prior to malting of an order vacating and abandoning said Street. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does determine that said Street should be abandoned and vacated subject to the following conditions: 1. The applicant will leave the existing drive- way in Lot 20 of said tract to provide for additional turn around area for trash and emergency vehicles. 2. Applicant will construct at no cost to the City, a new sewer manhole at the easterly terminus of the remaining portion of Hermosa Drive. 3. Applicant will, at no cost to the City, install street improvements required to pro- vide for the proposed new cul-de-sac area and submit street improvement plans to the City Engineer for review and approval. BE IT FURTHER RESOLVED that should the conditions set forth in the preceding paragraph be fulfilled within one hundred eighty (180} days of the date of this Resolution, the City Council will make its order vacating; and abandoning said Street. BE IT FURTHER RESOLVED that should all of said conditions not be fulfilled within said one hundred eighty (180) days or such further time as the City Council may grant, -2- then this Resolution shall terminate, and resort shall be had to a new and separate proceeding.
