78-086RESOLUTION IVO. 78R-86 A RESOLUTION OF THE CITY COUNCIL OF s'HE CITY OF Ai'rtAHEIM ORDERING THE VACATION AND ABAi~VDOIv- MENT OF A CERTAIN PUBLIC SERVICE EASEMENT. WHEREAS, the City Council of the City of Anaheim has elected to proceed pursuant to the provisions of the Public Services Easements Vacation Law (Section 50430 et seq. Government Code) in connection with .the vacation and abandonment of public service easements; and W~iEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the follow- ing described public service easement (hereinafter "Easement"), to wit: That certain 5-foot wide public utility easement located in the City of Anaheim, County of Orange, State of California, lying within Lot 138 of Tract No. 8075, as shown on a map recorded in Book 354, pages 4 to 10, Miscellaneous Maps, records of said Orange County, the easterly line of said 5-foot strip is described as follows: Beginning at the intersection of the southerly line of said Lot 138 with the westerly right of way line of Colter Circle (50 feet wide), as shown on the map of said Tract No. 8075; thence N 31° 49' 38" E, 22.09 feet to the beginning of a tangent curve con- cave southwesterly and having a radius of 93.00 feet; thence northerly along said curve through a central angle of 38° 30' 00" an arc distance of 62.49 feet to the beginning of a reverse curve concave easterly and having a radius of 45.00 feet; thence northerly along said reverse curve through a central angle of 68° 24' 53" an arc distance of 53.73 feet to an inter- section with the southwesterly line of Lot 139 of said Tract No. 8075, said point of intersection being the point of terminus of the line herein described; and WHEREAS, on the 31st day of January, 1978, a public hear- ing was held to allow interested persons to submit evidence concern- ing said proposed abandonment; and WHEREAS, the City Council of the City of Anaheim does ....,. find from the evidence submitted to it, that said Easement is un- necessary for present or prospective public use. -1- 77-11A NOW, THEREFORE, BE IT SOLVED that the City Council of the City of Anaheim does hereby order the vacation and abandonment of said Easement. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of Anaheim to be recorded in the Office of the County Recorder of Orange County, California.
