BETIhTEEN THE ANAHEIM REDEVELOPr~'IEI1T AGENCY AND W & D COMMERCIAL PROPERTIES, INC. FOR. THE SALE AldD DEVELOPMENT OF TIiAT CERTAIN REAL PROPERTY BOUNDED BY REALIGNED LINCOLN AVENUE OIJ THE NORTH, ANAHEIM BOULEVARD ON ^1 NE EAST, OAK STREET ON THE SOUTH, Ai~TD REALIGNED CLEMEi~1TIiJE STREET ON THE WEST Iid REDEVELOPP•~ENT PROJ~~'CT ALPHA. WHEREAS, the Anaheim Redevelopment Agency (the "Agency") has prepared an Initial Study of the environmental impact of the proposed Disposition and Development Agreement (the "Agreement") between the Agency and UST & D Commercial Properties, Inc.; and WHEREAS, the City Council of the City of Anaheim (the "City Council") has reviewed and considered the Initial Study, the Final Environmental Impact Report for Redevelopment Project Alpha (the "Project"), and the Final Subsequent Environmental Impact Report for the Second Amendment to the Proj ect; and WHEREAS, the Agency has found on the basis of the Initial Study that the environmental impact of the proposed Agreement is essentially the same as those in the previous Environmental Impact Reports; and that there is no additional information or date available requirin~~ supplementation of the previous Environmental Impact Reports; and WHEREAS, said Initial Study conflorms to the rer_uire- ments o.f. the California Environmental Quality Act of 1970 (Public Resources Code, Section 21000 et seq.), the "Guidelines for the Implementation of the California Environmental Quality Act of 1970", as amended, adopted by the Secretary for Resources of the State of California, and the Procedures for Implementation of the California Environmental Quality Act o_f 1870 adopted by resolution of the Agency. NOti+J, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: The City Council hereby finds and determines that: -1- (a) Neither the approval nor the implementation of the proposed Agreement will cause substantial changes in the Redevelopment Project, or with respect to the circumstances under which the Project is to be undertaken, which will require major revisions in the Environmental Impact Reports previously adopted for the Project due to the involvement of new environmental impacts not covered in said previous Environmental Impact Reports; (b) The Initial Study is approved and no Subsequent Environmental Impact Report or Supplement to an Environmental Impact Report is necessary or required; and (c) The proposed action will have no significant effect on the environment, except as identified and considered in the previous Environmental Impact Reports.
