78-008RESOLUTION N0. 78R-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS THEREOF FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 11TH DAY OF APRIL, 1978. WHEREAS, Section 10012 of the Elections Code. of the State of California authorizes the governing body of any local agency to adopt regulations pertaining to materials prepared by any candidate for a municipal election, includ- ing costs thereof; and WHEREAS, it is the opinion of the Attorney General of the State of California (No. CV 76/5, May 6, 1976) that a candidate may not be billed for the additional cost of preparing candidates' statements in Spanish if such were not requested by the candidate but were required solely by reason of recent amendments to the Federal Voting Rights Act of 1965 (Public Law 94-73. August 6, 1975); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to Section 10012 of the Elections Code of the State of California, each candidate for elective office to be voted for at the General Municipal Election to be held in the City of Anaheim on the 11th day of April, 1978, may prepare a candidate's statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description of no more than two hundred (200) words of the candidate's education and qualifications expressed by the candidate himself. Such statement shall not include party affiliation of the candidate,. nor membership or activity in partisan political organizations. Such statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. Such statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. SECTION 2. That in compliance with the recent amendments to the Federal Voting Rights Act of 1965 (Public Law 94-73, August 6, 1975) the City Clerk shall provide a Spanish translation of the candidate's statement to be included in the Voter's Pamphlet and mailed with the sample ballot to each voter in said City. SECTION 3. That the '',City Clerk shall send to each voter with the sample ballot, a voter's pamphlet ~+thich contains the statement of each candidate in English and Spanish pursuant to law. K~ SECTION 4. That each candidate filing a candidate's statement shall be billed for the services rendered, a sum not greater than the actual prorated costs of printing and handling for the English version only, and such bill shall be due and payable no later than seven (7) days after said bills are received by the candidate. ,.r~. SECTION 5. That the City Clerk is hereby authorized and directed to send said bills by certified mail. SECTION 6. That the City Council finds and determines that no materials, other than the voters pamphlet containing the candidate's statement, shall be sent to voters with the sample ballot. SECTION 7. That the City Clerk shall provide each candidate or the candidate's representative a copy of this Resolution at the time nominating petitions are issued. SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
