78-419RESOLUTION NO. 78R -419 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R -600 AND AMENDED BY RESOLUTION NOS. 73R -255, 73R -387, 73R -532, 74R -433, 75R -315, 75R -469, 74R -479, 76R -378 AND 78R -418. WHEREAS, the City of Anaheim maintains a water distribution system for the furnishing of water to residents and inhabitants of the City of Anaheim; and WHEREAS, it is desirable and necessary that charges for service be fixed; and WHEREAS, it is the policy of the City Council that Anaheim's Water Utility shall be self - supporting from charges made by the City for installation of water mains, for water furnished to consumers and for all services rendered in connection therewith; and WHEREAS, the cost of many individual items of labor, materials and equipment used by the Water Utility has increased substantially since the present water installation fees were established; and WHEREAS, the Public Utilities Board has recommended increasing water installation fees to conform with the revenue requirements of the 1978 -79 budget; and WHEREAS, Section 10.16.420 of the Anaheim Municipal Code provides that the City Council shall, by resolution, establish fees to be charged by the City of Anaheim for water main installations and services rendered in connection therewith. DISTRIBUTION SYSTEM (Continued) 4. Primary Distribution Mains a. Primary Distribution Mains which supply water to all areas of the system shall be paid for by acreage fees assessed on all properties in the system except those properties excluded in (1) above. The fees will be based upon gross acreage served by domestic water service and /or fire protection, and will be due at the time application for water service is made, or the property is developed. This does not apply to application for temporary or irrigation service. The water main extension fees - shall be $850 per acre. The above fees will be calculated to the nearest one hundredth (.01) acre. Publicly -owned facilities such as freeways, flood' control channels, and water spreading basins may not be required to pay the water main extension fees if water service for these properties is not required. If a portion of these facilities require water service, the water main extension fees shall be paid on that portion requiring service. b. When a Primary Distribution Main must be extended to a new subdivision or development, the Utility will extend the main up to five hundred (500) feet. if an extension greater than 500 feet is required, the developer will pay for the extension that is in excess of 500 feet, in addition to the normal water main extension fees. The developer's portion of the cost shall be reimbursed to him without interest as acreage fees are col- lected from others connecting to the extended main within a refund area designated by the Utility at the time the advance is made. The reimbursement agreement shall be in effect for a period of ten (10) years. • In no case shall the reimbursement exceed the developer's cost of the extension. (Continued) ISSUED BY Gordon W. Primary Distribution Mains (Continued) If the Utility requires a main larger than that required to serve a new development, the developer will only pay the cost of the size required to serve his property (min- imum of 8 -inch for residential, 10 -inch for commercial, and 12 -inch for industrial.). c. Normal practice of the Utility is to extend all Primary Distribution Mains. In unusual circumstances, the applicant for water service, who requires Primary Distribution Mains, may be permitted, if qualified in the judgment of the Utility, to construct and install the mains himself, or arrange for their installation pursuant to competitive bidding procedures initiated by him and limited to contractors who possess a current California Contractor's License permitting them to do this type of construction work. The cost, including the cost of inspection and supervision by the Utility, shall be paid directly by the applicant. The applicant shall provide the Utility with a statement of actual construction cost in reasonable detail. The installation shall be in accordance with the plans and specifications prepared by the Utility. For purposes of making any reimbursement to applicant or crediting applicant with payment of water fees the cost of the main extension made by applicant shall be deemed to be the lesser of (1) the actual cost or (2) the Utilities per foot cost of water mains used in determining the water main extension fees. d. DISTRIBUTION SYSTEM (Continued) 5. The Secondary Distribution System will be paid for and installed by the owners or developers of the property that the system serves. The requirements for the Secondary Distribution System will be set forth by the Utility. The Secondary Distribution System shall be designed and built in accordance with the Utility's requirements and specifications, and shall be subject to its inspection. After completion of the system, the owner shall dedicate it to the Utility, free of all liens, together with all necessary rights -of -way for future maintenance and upkeep. a. Where a Secondary Distribution System must be extended to a new subdivision or development, the system shall be paid for and installed by the developer of the property to which the system is extended. If, under this rule, a developer is re- quired to extend a system, which will later serve additional property, the Utility shall co!-lect and return to the developer the proportionate cost of the system serving the additional property, if and when such property is developed. b. The Utility may extend portions of the Secondary Distribution System prior to development at its cost provided these exten- sions are considered to be in the best interests of the Utility. The costs for any such extensions shall be reimbursed to the Utility by the owners or developers of the property served by these extensions when these properties are developed, or ap- plication for water service is made. c. Where half streets are developed, the developer of the half street shall be required to pay for and install any portion of the Secondary Distribution System that is required by the Utility. The proportionate share of the main's cost shall be collected by the Utility from the owner or developer of the remaining side of the half street when it is developed. This fee shall be reimbursed to the original developer. ISSUED BY Gordon W. The Utility shall charge an Inspection Fee of $17.00 per hour for time spent inspecting the Secondary Distribution System installed by a developer or his contractor. The developer shall pay this fee prior to final acceptance of these water improvements. e. The Utility shall charge a Plan Check Fee of $17.00 per hour for time spent checking or reviewing plans for additions to the Secondary Distribution System. The Utility shall estimate the Plan Check Fees when plans are first submitted, and this estimated cost shall be deposited before plan check or plan review begins. When the plan check process is completed, the Utility shall collect or refund the difference between the estimated cost and the actual cost of plan check. 6. Main Enlargements - When the Utility's present distribution system will not meet the water demands of a customer or developer, the customer or developer may be required to pay the cost of any necessary main replacement, less credit for the expired life of the existing main. GENERAL 1. For all services, other than those where the developer is installing the main, the Utility shall furnish and install the service connection, meter and meter box after application is made and all applicable fees are paid. 2. In new subdivisions, and in other cases where the developer installs the mains, the developer shall furnish and install the service con- nection and meter box, and the Utility shall furnish and install the meter. 3. The service connection, meter, and meter box will generally be in- stalled at a convenient location between the curb or edge of pavement and the property line. if it is considered impractical to install the facilities in this location, they may be installed upon the customer's premises,in which case an easement will be required. 4. The service connection will generally determine the point of delivery, of water service to the customer. B. SERVICE CONNECTION AND WATER METER INSTALLATION CHARGES 1. For service connections and water meter installations under (3) and (4) below, all materials shall be furnished and installed by the Water Division. 2. For service connections and water meter installations under (5) and (6) below, the service connection and meter box shall be furnished and installed by the developer in accordance with Water Division specifications. The meter shall be furnished and installed by the Water Division. It is intended that (5) and (6) below apply to new subdivisions and other developments where the developer is installing the in -tract water distribution facilities. 3. All connections larger than two inch and any special service, including fire lines shall be made at a charge equivalent to the cost of all labor, materials, rental of equipment, and miscellaneous and incidental costs (excluding bores where bores are required on only one side of a street). a. Application for Connection in Excess of Two Inches, Special Services and Fire Lines. Request for such services shall be made to the Utilities Department, Water Division, who shall estimate the cost of said installation.
