78-386RESOLUTION NO. 78R -386 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REVOKING CONDITIONAL USE PER14IT NO. 1785 AND DECLARING RESOLUTIONS NO. 78R -45 AND 78R -109 NULL AND VOID. WHEREAS, on January 17, 1978, the City Council of the City of Anaheim did, by Resolution No. 78R -45 grant Conditional Use Permit No. 1785, subject to certain conditions therein speci- fied; and WHEREAS, on February 14, 1978, the City Council did hold a rehearing on said matter and thereupon did adopt Resolu- tion No. 78R -109 reaffirming its approval of Conditional Use Permit No. 1785; and WHEREAS, on June 13, 1978, the City Coundil did conduct a duly noticed public hearing pursuant to the provisions of Section 18.03.091 of the Anaheim Municipal Code to determine if grounds existed under the provisions of Anaheim Municipal Code Section 18.03.092.040 for the termination of Conditional Use Permit No. 1785 for exercising said permit contrary to the ex- press terms or conditions of approval; and WHEREAS, after considering all of the evidence and testimony offered at said hearing, the City Council does hereby find that the permittee has exercised Conditional Use Permit No. 1785 contrary to the express terms or conditions of approval con- tained in Resolution No. 78R -45, as follows: 1. Permittee has violated Condition No. 5 of Resolution No. 78R -45 by failing to install and maintain an eight -foot block wall and extend the height of the existing six -foot wall to completely enclose the property within ninety (90) days following the date of approval of Resolution No. 78R -45; and 2. Permittee has violated Condition No. 6 of Resolution No. 78R -45 by conducting work after 6:00 p.m. daily and on Sat- urdays and Sundays, and conducting mechanical work other than minor repairs. 3. Permittee has violated Condition No. 7 of Resolution No. 78R -45 by utilizing power tools in conducting said work. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that, for each of the reasons hereinabove specified, Conditional Use Permit No. 1785 be, and the same is hereby, revoked and Resolutions No. 78R -45 and 78R -109 are hereby declared null and void. -1- THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13th day oL June, 1978.
