A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING CONDITION NO. 1 OF PESO-
LUTION NO. 78R-125 APPROVING CONDITIONAL USE
PER1 NO. 1793.
WHEREAS, the City Council has heretofore approved
Conditional Use Permit No. 1793 by Resolution No. 78R125 and
imposed certain conditions of approval thereon; and
WHEREAS, the applicant has heretofore requested an
amendment of Condition No. 1 of said Resolution to delete the
requirement that sidewalks be constructed at this time; and
WHEREAS, the City Council has held a duly noticed
public hearing upon said requested amendment; and
WHEREAS, it is in the public interest and convenience
to amend said Resolution in the manner hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Condition No. 1 of Resolution No.
73R-125 be, and the same is hereby, amended to read as follows:
Ill. That all engineering requirements of the City
of Anaheim along North Street, including preparation of
improvement plans and installation of all improvements
such as curbs and gutters, sidewalks, street grading
and paving, drainage facilities or other appurtenant
work, shall be complied with as required by the City
Engineer and in accordance with standard plans and
specifications on file in the office of the City Engi-
neer; and/or that a bond, certificate of deposit, letter
of credit, or cash, in an amount and form satisfactory
to the City of Anaheim, shall be posted with the City
to guarantee the installation of the above-mentioned
requirements; provided, however, that the installation
of sidewalks shall be required within 24 months from
the date of this Resolution, or at the time sidewalks
are installed upon either of the adjacent properties,
whichever occurs first."
BE IT FURTHER RESOLVED that, except as amended herein,
Resolution No. 78R-125 shall remain in full force and effect.
THE FOREGOING ,RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 23rd day of May
1978.
