A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DECLARING THE NECESSITY PURSUANT TO
GOVERNMENT CODE SECTION 39576.5 TO CONTRACT FOR
THE CUTTING AND REMOVAL OF ALL RANK GROWTH AND
WEEDS, AND REMOVAL OF RUBBISH, REFUSE AND DIRT
UPON ANY PARCEL OR PARCELS OF REAL PROPERTY OR
ANY PUBLIC STREETS WITHIN THE CITY OF ANAHEIM,
CALLING FOR BIDS THEREON, AND AUTHORIZING
PUBLICATION OF NOTICE THEREFOR, ACCOUNT NO.
10 -4380- 202 -10. (1978 -1979)
WHEREAS, pursuant to Title 6, Chapter 6.16 of the
Anaheim Municipal Code, regulations have been established for
the abatement of rank growth, weeds, rubbish, refuse and dirt
upon any parcel or parcels of real property or any public
streets within the City of Anaheim; and
WHEREAS, Government Code Section 39576.5 authorizes
the City Council to abate such nuisance by awarding a contract
on the basis of competitive bids for the cutting and removal
of such rank growth and weeds and removal of rubbish, refuse
and dirt; and
WHEREAS, the City Council finds that public
convenience and necessity require that such rank growth, weeds,
rubbish, refuse and dirt be cut and removed as quickly as
possible because of the noxious nature thereof, and further
finds that the foregoing can best be accomplished by awarding a
contract therefor as aforesaid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all rank growth, weeds, rubbish, refuse
and dirt upon any parcel or parcels of real property or public
streets within the City of Anaheim be cut and removed therefrom
by contract on the basis of competitive bids, and that said bids
shall include the furnishing of all labor and equipment to cut
and remove all rank growth, weeds, rubbish, refuse and dirt upon
all lots, parcels and areas within the City of Anaheim as
directed by the Chief of the Fire Department.
BE IT FURTHER RESOLVED that said bids shall specify
unit prices for the following estimates:

BE IT FURTHER
RESOLVED that the City
Clerk
of the City
of Anaheim be, and she
is hereby, authorized
and directed
to
publish
a notice according
to law, inviting sealed
proposals
for
the furnishing of all labor
and equipment to
cut and remove rank
lots, parcels and
growth, weeds, rubbish,
the City of
refuse and dirt upon
Anaheim as directed
all
by the Chief of the
areas within

Fire Department in accordance with specifications on file in the
Fire Department and the City Clerk's Office, and fixing the 25th
day of May, 1978, at the hour of 2:00 o'clock P.M. as the
date and hour for the opening of said bids at the City Council
Chamber in the City Hall of the City of Anaheim, and that said
notice shall be published twice, the first of which publications
shall be at least ten (10) days prior to the date fixed for the
opening of bids, and that said publication shall be at least five
(5) days apart.
AND BE IT FURTHER RESOLVED that the successful bidder
or bidders shall be required to enter into a contract with the
City of Anaheim in the manner and form approved by the City
Attorney of the City of Anaheim for the furnishing of the labor
and equipment and the performance of the work contemplated in
said bid in accordance with the notice inviting sealed proposals,
this resolution, and all applicable City ordinances or code
sections, and the laws of the State of California, and shall be
required to post bonds and insurance in the amounts and within the
time required by law as specified in the notice inviting sealed
proposals, and in a form approved by the City Attorney.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 9th d ater of May, 1978.
