A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF A LICENSE AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND THE ATCHISON, TOPEKA AND SANTA FE
RAILWAY COMPANY (Test Bore Site, North of
Lincoln Avenue, East of South Atchison Street).
WHEREAS, the City of Anaheim has heretofore
requested permission from The Atchison, Topeka and Santa Fe
Railway Company (hereinafter "Railway Company ") to drill
test holes within certain right -of -way owned by said Railway
Company within the City of Anaheim; and
WHEREAS, said Railway Company has submitted to the
City of Anaheim a .License Agreement to permit such activities,
which License Agreement has been reveiwed and found to be
satisfactory and in the best interests of the City of Anaheim;
and
WHEREAS, the compensation specified for said license
has heretofore been forwarded to City by the firm of Moore
& Tabor, consulting engineers and geologists heretofore
retained by the City for purposes of conducting and tests.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
License Agreement between the City of Anaheim and The Atchison,
Topeka and Santa Fe Railway Company be, and the same are hereby,
approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized and directed to execute
said License Agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 9th day of
