A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH -
MENT PERMIT WITH JAMES RONALD SPANGLER AND
BARBARA DALE SPANGLER (77 -11E).
WHEREAS, James Ronald Spangler and Barbara Dale
Spangler, husband and wife, hereinafter referred to as
Licensees, are the owners of property in the City of
Anaheim over which the City owns a public utility easement;
and
WHEREAS, Licensees wish to encroach upon a portion
of said easement for the purpose of constructing a six foot
(6 high block wall; and
WHEREAS, unless Licensees are allowed to encroach
upon the easement of the City, an extreme and undue hardship
will be caused to them; and
WHEREAS, the proposed encroachment for such instal-
lation across a portion of the easement of City will not
interfere with the present use of the easement by the City.
ATOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and James
Ronald Spangler and Barbara Dale Spangler be, and the same
are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said license
agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 25th day of
April , 1978.
