WHEREAS, a. request has been made for the abandonment of on eosement for public utility purposes upon, alone, over and throuja the property hereinafter. described; end WHERE, the City Council does elect to proceed under the provisions of the Petblic Service Easement Vocation Law, Title 5, Division 1, Article 5 of the Government Code, to abandon said nubile utility easement. NOW, THEREFOFE, B IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare that it intends to vacate, abandon and close to public use an easement for public utility purposes upon, alone, over and throunh the followinE; de- scribed property situeted in the City of Anaheim, County of Orange, State of California, to wit The Northerly 10.00 feet of Lot 19 of Tract No. 1178, as shown on a map filed in Book pq,,, 0 v. ene 6 of Mi s c ellaneous Leps, Records of Oranfe County, California; and that it does elect to proceed under the provisions of the Pub- lic :eervice Easement Vacation Low, Title 5 Division 1, Article 5 of the Government Code; end 22, IT FURTHER 2OLV2,i) that reference is hereby made to a mau on file in the office of the City Clerk for further particu- lars as to the proposed vacation, abandonment and closin to public use of said easement; and 7E IT FURTHER REEOLVED that a time and piece for hearin all persons interested in or objectinz, to the proposed vacation and abandonment shall be fixed not less then fifteen (15) days from the date of the pessae of this Resolution. That the 19th day of April 1960, at 7:00 o'clock P. M., in the Council Chamber in the City Hell in tho City of Anaheim is hereby fixed as the time end olace for e. publie hesrinf on the matter of such vacation, abendonment and cloaina to public use of said ease- ment for public utility purposes, for all persons interested in or ob:jectin: to such proposed vacation, abandonment and closin7 to public use to appear and show cause, if any they have, why such easement and the use thereof for the pureoses hereinebove men- tioned should not be vacated, abandoned and closed to public use; and IT FURTHER REe0EVED that notices of such proposed vacation and abandonment of said easement and the use thereof for the eurposes herein mentioned shall be posted conspicuously elona the line of said. easement at least ten (10) days before the date set for said hearin. Such notices shall be oosted not more than TTEST: (SEAL) -2 300 feet apart, and at least three (3) such notices shall be posted. Such notices shall state the pas ,e of this Resolution of Intention and the time and lace of the hearin:7 upon the matter of such vacation and abandonment of said easement; and BE IT FURTER RELOLVD that proof of publication of any notice required by this Resolution shall he made by affidavit as provided in the Code of Civil Procedure, and eroof of postinL; of any such notice shell be made by affidavit of the person postirv; the notice, setting forth the facts rezardim: such postin:7; and BE IT YUI-IR 2ff;301,VD that tha City Clerk shall certify to the passaL of this Resolution and shall cause the same to be published in the manner prescribed by law, in the Anaheim Gazette, a. newspaper of 7eneral circulation, printed, published and circu- lated in sai d City of ;._naheim.
