1960-5781RESOLUTION NO. 5781 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1186. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from BROADWAY VIL OF ANAHEIM owner, of certain real property situated in the ty of Anaheim, County of. Orange, State of California, described as follows° The East 150.00 feet of the South 150.00 feet of the Northeast quarter of Section 8, Township L South, Range 10 West, partly in the Rancho Los Coyotes and partly in the Rancho San Juan Cajon de Santa Ana, in the city of Anaheim, county of Orange, state of California, as said Section is indicated on a map filed in Book 40, page 6 of Record of Surveys, in the office of the County Recorder of said county. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Jan1F ry 1� 1960 notices of which said public hearing were duly given as re- quired by law and the pr visions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence ar and reports offered at said hearing, did adopt Resolution No. 146 Series 1959-60 denying Variance No 1186 and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on January 26 1960 at 700 o'clock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provi- sions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and de- termine that 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zones -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying the application of BROADWAY VILLAGE OF ANAHEIM, 801 North Loara Street, Anaheim., California, for a zoning variance to permit on -sale liquor in the coffee shop restaurant proposed to be erected on the property hereinabove described, be and the same is hereby sustained, and that Variance No. 1186 be, and the same is hereby denied.
