1960-5769RESOLUTION NO. 5769 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL C ODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofor K duly passed a,d adopted a resolution declar- ing its intention to change the boundr:ies of the zone or zones hereinafter mentioned -;aid described ,-.nd did fix time and place for the holding of a public hearing thereon in th manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public h aring to consider said proposed change of zone or zone:, and did receiv: evidence and reports from persons interest therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning C•.msission did duly announce by formal resolution its findings of f,cts >.nd declare; its opinions and reaso:•, for r commending an amendment to said Article IX, Chapter 2 of the: Anaheim Municipal Code to effect the proposed change in the b•undaries of th zone hereinafter mentioned and described; and WHEREAS, upon r of the report and recommendation of the City Planni:,g Commission, th City Council did thereupon fix the th day of Janu r D 19 6,0 as the time and the Council. IX, Chapter 2 of the Anaheim Mici.p =i Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly held and conduct such public hearing and did give all persons inters. =ted therein an opportunity to be heard and did r ceive evidence and reports, and did thereupon con- sider the recommendation of the City Planning Commission and WHEREAS, the City Council does find and determine that the property and are proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zon or zone:, to which it is proposed to change said property and area and that the inclusion of said prop- erty and area in such new zone or zones will increase the value of said property and area and will not depr elate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by th City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, Stag of California, described as followso to wito -1- That portion of Lot 35 of Anaheim Extension in the City of Anaheim, as shown on a map of survey made by William Hamel and filed for record in the office of the County Recorder of Los Angeles County, California, and being the North 125..74 feet of the Southerly 52 acres of the following described tract: F- 59 -60 -59 Commencing at a stake marked "W. N. H." and "H. C. K." on the South line of Section 9, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, the same being the Southwest corner of a twenty acre tract of land sold by D. W. C. Cowan to Dr. Wm. N. Hardin, by deed recorded in Book 34, at page 457, of Deeds, records of Los Angeles County, California; running thence North 1024 feet more or less, to an old corner post marked "H. C. K. thence East 363.7 feet; thence South 1024 feet, more or less, to the South line of said Section 9; thence West 363.7 feet to the point of beginning. be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE, to C -1, NEGH- BORHOOD- CONNERCIAL ZONE, upon the following conditions: 1. That the owner of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney. 2. That the buildings to be constructed on subject property be erected in conformance with the plot plan and renderings this day submitted to the City Council and on file with the City of Anaheim. 3. That sidewalks be constructed along Lincoln and Wilshire Avenues as required by the City Engineer, and in accordance with standard specifications on file in the office of the City Engineer. 4. That an area 10 feet in width along Lincoln and Wilshire Avenues be landscaped and said landscap- ing maintained. 5. That the owner of subject property pay to the City of Anaheim the sum of 42 per front foot along Lincoln and Wilshire Avenues, for street lighting purposes. 6. (a) That the owner of subject property deed to the City of Anaheim a strip of land of a maximum width of six feet, along the easterly boundary of subject property, for drainage purposes, and (b) improve said drainage easement in accordance with plans prepared by the City Engineer and grades set by said City Engineer. 7. That a 6 -foot block wall be constructed along the east and north sides of subject property, the wall on the east side of the property to be con- structed on the east side of the drainage easement and to terminate at the South side of the alley north of Lincoln Avenue. 8. That the owner of subject property deed to the City of Anaheim a strip of land of varying width, the maximum width of which shall be 10 feet, along Wilshire Avenue for reconstruction of curb return, the reconstruction work to be performed by the City of Anaheim. 9. That a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the construction of the sidewalks, the storm drain and block walls hereinabove mentioned. 10. That Conditions No. 1, 5, 6(a), 8 and 9 hereof be complied with within a period of 90 days from date hereof, or such further time as the Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
