A RESOLUTION OF THE CITY COUNCIL 01 THE CITY 07 ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITT, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMP- LISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has here- tofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its find- ings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 19th. day of January 19 6.D as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all per- sons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoin- ing zones. NOW, THERE/ORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The South 120 feet of the North 170 feet of the East 100 feet of that portion of the West half of the Northwest quarter of Section 23, Township L South, Range 11 West, S.E.E. 8. iii., lying Northeasterly of the Northeasterly line of land de- scribed in Deed to the Los Angeles Interurban Railway Co. recorded September 8, 190, in Book 122, Page 184 of Deeds, Records of Orange County, California. be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property place of record stand- ard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney. -1- F- 59 -60 -63 2. That the residence now located on subject property be removed. 3. That a minimum building setback line of 35 feet be maintained on Bali Road. L. That the owner of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Bali Road., for street widening purposes. 5. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the instal- lation of said engineering requirements. 6. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 7. That all of the above conditions, with the exception of Conditions Nos. 2, 3 and 5(a), be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined tc be necessary and proper.
