1960-5761RESOLUTION NO. 5761 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING THAT CERTAIN CONTRACT ENTERED INTO ON JUNE 1, 1958, BY AND BETWEEN THE CITY OF ANAHEIM AND WARREN W. JAYCOX, FOR THE COLLECTION AND DISPOSAL OF GARBAGE, RUB- BISH AND WASTE MATERIAL IN THE CITY OF ANAHEIM, BY INCREASING THE COMPENSATION PAYABLE. WHEREAS, the City of Anaheim did heretofore, to wit, on June 1, 1958 enter into a contract with Warren W. Jaycox, for the collection and disposal of garbage, rubbish and waste material in the City of Anaheim; and WHEREAS, a review of said contract by the City Council indicates that the compensation payable under the terms thereof is inadequate by reason of the annexation of additional populated areas to the City and the increase in the distance required to be traveled to dispose of said garbage, rubbish and waste material, and the consequent increased cost to the Contractor to adequately serve the City in garbage and rubbish pick -up and disposal; and WHEREAS, the City Council finds that the expansion of the area covered by the contract and the increased costs involved warrant an increase in the compensation payable to the Contractor, and that such increase should be effective as of January 1, 1960; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the contract heretofore made and entered into on June 1, 1958, by and between the City of Anaheim and Warren W. Jaycox, for the collection and disposal of garbage, rubbish and waste material in the City of Anaheim be, and the same is hereby, amended by increasing the compensation payable to said Warren W. Jaycox under the terms of said contract to the sum of $19,500.00 per month, plus 80 cents per residence served by the Contractor but not served with other utilities by the City and, therefore, not ordinarily billed by the Anaheim Customer Utility Service (formerly the Anaheim Public Service Department), the Contractor to be responsible for billing and collecting from all such residences not ordinarily billed by the Anaheim Customer Utility Service, as more particularly set forth in the contract, and the City to be in no way liable for payment of such portion of the Contractors compensation, said increase in compensation to be effective as of January 1, 1960. BE IT FURTHER RESOLVED that in all other respects said contract shall be and remain in full force and effect. THE FOREGOING RESOLUTION is approved and signed by me this 12th day of January, 1960.
