1959-5721RESOLUTION NO. 5721 "'- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING THE REQUEST OF HAROLD KO PIT, D.V.M. FOR A SPECIAL USE PERMIT TO OPERATE A DOG AND CAT HOSPITAL. WI~iEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Special Use Permit from Harold Kopit, D.V.I~i., 1l~624 Dalmatian Avenue, La Mirada, Cali- fornia, to construct and operate a dog and cat hospital on the following described property: All that certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: The North 180 feet of the West 68.00 feet of the East 160.00 feet of Lot 6 of Tract No. 162, as shown on a map thereof recorded in Book 12, Page 6, Miscellaneous Maps, Records of said Orange County. EXCEPTING THEREFROI~I the South 1G feet thereof reserved for an easement far road purposes. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on December 7, 1959, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WI-IEREAS , gation and studies due consideration hearing, did adopt Special Use Permit and said Commission, after due inspection, investi- made by itself and in its behalf ar~d after ~f all evidence and reports offered at said its Resolution. No. 127, Series 1959 -60 granting No. 57 upon the conditions therein set forth; WHEREAS, thereafter, within tGtenty days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission granting said Special Use Permit, and said appeal was set for public hearing on December 2g, 1959 at 7:GO otclock P.M. at the City Ha11 in the Gity of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive; evidence and reports; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. -1- NO~~~, T'riEREFORE, BE IT RESOLVED. by the City Council of the City of Anaheim that the action of the City Planning Commission -_LL~ granting Special Use Permit No. 57 to Harold Kopit, D.V.M., 1l~62~ Dalmatian Avenue, La Mirada, California, to construct and operate a dog and cat hospital, with no outside pens or runs, on the property hereinabove described, be and the same is hereby dis- approved, and that Special Use Permit No. S7 be and the same is hereby denied.
