1959-5714RESOLUTION NO, 5714 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AIVAHEIT~I FIiVDING AND DETERTYiIidING T?.AT A CHANGE OF ZONE IS idECESSARY Itv CERTAIiu AREAS OF THE CITY, AID THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE ANiEI1DED TO ACCOIviPLISH SAID C RANGE OF ZOiVE o WHEREASg the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten tion to change the boundaries of the zone or zones hereinafter men boned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Codeg and did duly hold and ~sonduct su~;h public hearing to consider said proposed change of zone or ~onesg and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (l.~.U) days following the final hearing thereon, the Planning Commission did duly announce by formal resol?~tion its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IXA Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WI~REASg upon receipt of the report and recommendation of tYiP City Planning Commission, the City Council did thereupon fix the 1st.. day of December , 19~' , as the time and the ~oi.znc~hamber in the Ci y Hal of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IXA Chapter 2 of the Anaheim Municipal Code; and WHEREAS at the time and place fixed for said public hear ing, the City Council did duly hold and conduct such public hearing a.nd did give all persons interested therein an opportunity to be hesrd and did receive evidence and reports9 and did thereupon conm cider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth9 is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will. increase the value of said property and area and will not depreciate the values of. property in adjoining zoneso NOW, THEREFORE9 BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: The j~Test half of the north half of the north half of the Southwest quarter of the i~TOrthwest quarter of °"""' Section 1l~, Township !.{_ South, Range 11 West, in t~:e RancYro Los Coyotes as sho.-an on a reap recorded in Book ~l, pa-,e 11 of Miscellaneous T~iaps, records of Orange County, California.. ~1~ _~. That the owners of subject property place of record standard City of AnaT~ieim R-3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit all buildings constructed on said property to one story in height, shall limit the number of units constructed on each lot to five units on the property described as Lots 1,; 3 and 4 of Tentative Tract No. 3552, and. srzall limit the number of units per lot to four on the remainder of ~~ subject property. 3. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Knott Avenue for street widening purposes. -2- l~.. (a} That all engineering requirements of the City of °~ Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied'-with as required by the City Engineer and in accordance with standard plans and specifications on rile in the office of the City Engineer; and (b} that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 5. That the owners of subject property pay to the City of Anaheim the surn of 2 per front foot for street lighting purposes. 6. That the owners of subject property pay to the City of Anaheim the sum of X25 per dwelling unit,. to be used for park and recreation puuposes, said sum to be paid at the time the building permit is issued. 7. That the final map of `T'ract No. 35~ be=recorded in the Office of the County Recorder of Orange County, California. 8. That all of the above conditions with the exception of Conditions No. 1, te(a) and 6 be complied with within a period of 150 days from date hereof, or such further time as the Council may grant.. BE IT FURTHER RESOLV:~;D that tT~ie City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to ~.rticle IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim TJlunicipal Code to accomplish the object herein found and determined to be necessary and proper..
