A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE PURCHASE AND
ACQUISITION OF CERTAIN REAL PROPERTY HEREIN-
AFTER DESCRIBED FOR PUBLIC PURPOSES.

WHEREAS, Dream Homes, Inc., a California Corpora-
the owner of the hereinafter described real property
in the County of Orange, state of California; and
WHEREAS, said owner has offered to sell said prop-
erty, together with the well, pump and all equipment situated
thereon for the sum of $3800.00; and
WHEREAS, Dream Homes, Inc., the owner of said prop-
erty, is or will become indebted to the City of Anaheim in
the near future by reason of charges of the City for water
meters, reservoir storage charges and off-site sewer charges
in connection with Tract No. 2878, in the approximate sum of
$5400.00; and
WHEREAS, said owner has offered to convey said
property to the City of Anaheim and accept therefor a credit
and set-off in the amount of $3800.00 against the sum which
is or shall become due and payable to the City by said owner
for water meter charges, reservoir storage charges and off-
sIte sewer charges in connection with Tract No. 2878; and
WHEREAS, the City Council does find and determine
that public convenience and necessity require the purchase
and acquisition of said real property hereinafter described,
together with the well, pump and all equipment situated there-
on, and that the offer of said owner to sell and convey said
property to the CIty of AnaheIm and accept tffirefor a credit
and off-set in the amount of $3800.00 against the sum which
is or shall become due and payable to the City, as herein-
above set forth, is fair and reasonable, and that the price
of $3800.00 is not out of proportion to the fair market value
of said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of Dream Homes, ~nc.,
a California Corporation, to sell, transfer and convey the
property situated in the City of Anaheim, County of Orange,
State of California, described as follows, to wit:
Lot 28 of Tract No. 2878, as per map recorded
in Book 92 at Pages 33 and 34 of Miscellaneous
Maps of the Records of Orange County, Cali-
fornia,

together with all appurtenances, the pump and all pumping
equipment situated thereon, and accept therefor a credit and
set-off in the amount of $3800.00 against tho sum which is
or shall become due and payable to the City by said Dream
Homes, Inc. for charges by the City for water meters, reser-
voir storage charges and off-site sewer charges in connec-
tion with Tract No. 2878, be, and the same is hereby, accepted
subject to the following conditions:

1. All general aTH] special taxes for the
fiscal year IS57-1958.
2. All covenants. conditions. restrictions,
reservations, rights, rights-of-way and
easements of record.
BE IT FURTHER RC:SOLVED that the Mayor and the City
ClerJ~ be, and they are hereby, authorized to enter into an
agreement with Dream Homes, Inc. for the purchase of the
property her2inabavc described, upon the terms and conditions
herein set forth, when a deed conveying said property to the
City of Anaheim. frEe anel clear o~' all encumbrances except
as hereinabove set forth, is delivered to the City, and a
policy of title insurance can be issued by a reputable title

free and clear of all encumbrances, except as hereinabove
spec if led.
AND BE IT F'URTHER t~FSOLVED that. Dream Homes, Inc.
shall pay the charges for furnishing a policy of title
insurance necessary to show title vested in the City of
Anaheim as herein provided.
THEF'ORECtOING RESOLUT ION is approved and signed by
